Chevron Ajukan Dana Pemulihan Lingkungan

    PT Chevron Pacific Indonesia telah mengajukan anggaran untuk kegiatan pasca-operasi berupa pembongkaran permanen fasilitas produksi dan sarana penunjang serta pemulihan lingkungan di Blok East Kalimantan. Direktur Teknik dan Lingkungan Kementerian Energi dan Sumber Daya Mineral (ESDM) Djoko Siswanto mengatakan, Chevron telah mengajukan anggaran untuk melakukan kegiatan pemulihan lingkungan (abandonment and site restoration/ASR) di Blok East Kalimantan.

    Kontrak Blok East Kalimantan yang dioperatori Chevron itu akan berakhir pada 2018. Dia memperkirakan, biaya yang dikeluarkan untuk menutup secara permanen sumur minyak di blok tersebut sekitar US$1.000 per sumur. Sementara itu, wilayah kerja migas yang akan dikelola oleh Pertamina itu terdapat sekitar 1.500 sumur aktif. Djoko menyebut, pihaknya masih menghitung jumlah sumur migas yang akan ditutup secara permanen dan sementara agar biaya yang dikeluarkan kontraktor lama (Chevron) dan operator baru (Pertamina) lebih efisien.

    Cadangan minyak yang tersisa pada suatu sumur, katanya, menjadi pertimbangan penutupan secara permanen atau sementara. Menurutnya, kendati dalam kontrak kerja sama yang ditandatangani belum menyebut secara tegas pihak yang menanggung biaya ASR,,kontraktor tetap memiliki kewajiban untuk melakukan kegiatan setelah Operasi sebelum kontrak berakhir. Dalam kontrak, terdapat satu klausul yang menjadi dasar penetapan kewajiban penyisihan dana ASR.

    Menurutnya, klausul untuk mengikuti peraturan yang berlaku bisa diterjemahkan bahwa pemerintah berhak menagih komitmen terkait kegiatan setelah operasi. Alokasi dana ASR diatur dalam Peraturan Pemerintah N 0. 35/2004 tentang Kegiatan Usaha Hulu Minyak dan Gas Bumi, kontraktor wajib mengalokasikan dana untuk melakukan pemulihan lahan. Dana harus disepakati karena akan tertulis dalam kontrak kerja sama sebagai dana cadangan khusus.

    Kendati wajib mencadangkan dana pemulihan lingkungan, anggaran itu termasuk salah satu jenis biaya Operasi yang dikembalikan pemerintah. Dalam Pasal 13, Peraturan Pemerintah No.79/2010 tentang Biaya Operasi yang Dapat Dikembalikan dan Perlakuan Pajak Penghasilan di Bidang Usaha Hulu Minyak dan Gas Bumi, alokasi dana ASR merupakan jenis biaya operasi yang dapat dikembalikan dalam penghitungan bagi hasil dari pajak penghasilan.

    Realisasi biaya ASR bisa dikembalikan bila lebih kecil dari biaya yang dicadangkan pada rekening bersama Badan Pelaksana dan kontraktor melalui proses persetujuan Kepala Badan Pelaksana. Tidak semua aturan di-copy paste ke kontrak. Cukup satu pasal sapu jagat, wajib mengikuti peraturan yang berlaku. Dalam kontrak, katanya, ASR wajib dilakukan setiap kontraktor sebelum meninggalkan wilayah kerja. Hal itulah, ujar Djoko, yang akan diterapkan pada kontrak kerja sama lainnya yang akan habis masa berlakunya.

    Seperti diketahui, hingga 2025 terdapat 35 wilayah kerja yang akan habis masa kontrak. Sebelumnya, Vice President Policy, Government dan Public Affair Chevron Yanto Sianipar mengatakan, sebagai operator, pihaknya menjalankan kegiatan sesuai dengan pengelolaan lingkungan yang diterapkan Kementerian Lingkungan Hidup dan Kehutanan. Oleh karena itu, pihaknya akan menjalankan kegiatan pemulihan lingkungan di Blok East Kalimantan. Produksi minyak di East Kalimantan sebanyak 24.000 barel per hari (bph) dan gas 60 MMscfd. Blok tersebut dikembalikan Chevron kepada pemerintah pada awal 2016.

Ask Chevron Environmental Restoration Fund
