Karenanya, pemerintah diminta Iebih fleksibel dalam menagih dana tersebut. Direktur Eksekutif IPA Marjolijn Wajong mengatakan, kontrak migas yang diteken sebelum 1990 memang tidak mewajibkan penyisihan ASR Padahal, jika menghitung jumlah sumur yang dibor selama berpuluh-puluh tahun, dana ASR yang diperlukan bakal cukup besar.

    Penagihan dana ini kepada Salah satu perusahaan, baik yang kontraknya habis ataupun yang mengambil alih pengelolaannya, akan menjadi beban berat. Sehingga mesti diajak bicara perusahaan-perusahaan untuk menghandle jalan keluarnya. Kalau tiba-tiba sekarang di ujung mesti menyediakan uang buat fasilitas yang akan diabandon, super minus,” kata dia. Bagi kontraktor yang mengambil alih kelola blok habis kontrak ini, pembebanan ASR disebutnya dapat memangkas keekonomian blok tersebut.

    Sementara jika ditagihkan kepada kontraktor lama, tidak ada dana yang dapat disetor mengingat memang tidak ada penyisihan dana sejak awai kontrak. Pemaksaan penagihan juga berpotensi terjadinya dispute antara pemerintah dan kontraktor. “Saya mengerti bahwa itu (fasilitas produksi tak terpakai) , harus dihandle. Secara teknis, jelas (harus dilakukan). Tetapi siapa yang bayar,” ujar Marjolijn. Karenanya, terkait penerbitan peraturan menteri soal ASR, IPA meminta pemerintah lebih fleksibel.

    ASR ditegaskannya tidak dapat dibebankan seluruhnya kepada kontraktor eksisting maupun kontraktor baru yang mengambil alih pengelolaan blok migas. Bisa saja, saran Marjolijn, beban ASR ini ditanggung keduanya. “Macam-macam caranya, bisa 100% yang baru, bisa kontraktor lama juga taruh uang," jelasnya. Menurutnya, perusahaan migas pasti berkomitmen membereskan lingkungan begitu operasinya selesai. Secara teknis pun, jika sumur tidak lagi dipakai, perusahaan pasti akan menutupnya.

    Biasanya, perusahaan migas telah menyisihkan dana untuk ini. Marjolijn hanya menyayangkan, bahwa isu ASR ini baru muncul begitu kontrak blok migas akan habis dalam satu-dua tahun lagi. Padahal, perpanjangan kontrak blok migas dapat diajukan dan dibahas 10 tahun sebelum kontrak habis sesuai Peraturan Menteri ESDM No 15/2015. Artinya, pembahasan ASR ini bisa saja dilakukan sejak jauh hari. Apalagi, tambahnya, bakal ada sekitar 30 kontrak migas sebelum 1990-an yang akan selesai masa kontraknya.

    Bagi saya, susah itu kasusnya (soal ASR). Mahal loh dana ASR, ujar dia. Sebelumnya, pemerintah menyebut tengah menyusun draft peraturan menteri yang khusus mengatur soal dana ASR ini. Rencananya, draft ini akan memuat cara menganggarkan hingga mencairkan dana tersebut. Hal ini sesuai dengan rekomendasi Badan Pemeriksa Keuangan (BPK). Pada Laporan Hasil Pemeriksaan BPK atas Laporan Keuangan Pemerintah Pusat 2015, BPK merekomendasikan agar pemerintah menyusun dan menetapkan kebijakan akuntansi terkait pencadangan dana ASR yang disimpan di dalam rekening bersama kontraktor kontrak kerja sama (KKKS) dengan Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas).

    Rekomendasi lainnya yakni agar Menteri ESDM dan SKK Migas segera berkoordinasi menyusun dan menetapkan tata cara penggunaan dana ASR, sebagaimana diatur dalam dalam Peraturan Pemerintah No.79/ 2010. Kemudian, BPKpun merekomendasikan agar Kepala SKK Migas memberikan sanksi secara tegas kepada KKKS yang tak mencadangkan ASR.Kemudian terkait rencana pemerintah menerbitkan peraturan yang mewajibkan pemasangan alat pengukur produksi migas (flow meter), IPA tidak keberatan.

    Namun, IPA meminta pemerintah juga menyiapkan ahli yang akan menganalisis hasil pengukuran tersebut. Menurut Marjolijn, setiap KKKS biasanya sudah memiliki dan memasang flow meter di fasilitasnya, mulai dari migas diproduksi hingga dilifting. Pasalnya, alat ini diperlukan perusahaan untuk perhitungan jual beli migas yang dilakukannya. Pemerintah memperoleh data tersebut mengingat KKKS pasti melaporkannya secara rutin kepada SKK Migas
