Business Competition Supervisory Commission investigate alleged violations of unfair competition related to the sale of gas by PT Perusahaan Gas Negara Tbk. Gas price is overvalued by among businessmen allegedly associated with monopolistic practices so that businesses do not have to buy gas alternative.
It was announced by Chairman of the Business Competition Supervisory Commission (KPPU) Syarkawi Rauf in Jakarta, Tuesday (4/4). "The investigation Commission based on a report related business operators of gas price fixing which was considered too high," said Syarkawi.
Statements related businesses in gas prices in North Sumatra, the Commission conducted an investigation to find two items of evidence. "There are allegations of monopolistic practices by setting the selling price is too high," he said.
Syarkawi added, reports from business operators, the selling price of gas reached 14.8 US dollars per million metric British thermal unit (MMBTU). The report was based on the events of 2015 and reported to the Commission in 2016 ago.
The Commission will hold a series of trials with the reported party, namely PT Perusahaan Gas Negara (PGN). In the trial, PT PGN will submit a report alleged violations related response of businesses to the Commission.
If the reported rejects alleged infringement, reported party must submit evidence, expert witnesses, and evidence of instructions to strengthen the dispute.
Related cases of alleged infringement, PT PGN corporate secretary Heri Yusup said that it was up to the Commission's processes "We follow the applicable rules and subject to the rules," he said. He has not known the trial schedule to be held on the Commission's "I do not know technically," he said.
According to Heri, the issue of high gas prices assessed not only associated with PT PGN, as many stakeholders involved in the distribution chain of gas. Rules governing the gas business too much.

KPPU Selidiki Dugaan Pelanggaran
Komisi Pengawas Persaingan Usaha menyelidiki dugaan pelanggaran persaingan usaha yang tidak sehat terkait penjualan gas oleh PT Perusahaan Gas Negara Tbk. Harga jual gas yang dinilai terlalu tinggi oleh kalangan pelaku usaha diduga terkait dengan praktik monopoli sehingga pelaku usaha tidak memiliki alternatif untuk membeli gas.
Hal itu disampaikan Ketua Komisi Pengawas Persaingan Usaha (KPPU) Syarkawi Rauf di Jakarta, Selasa (4/4). ”Penyelidikan KPPU didasarkan pada laporan pelaku usaha terkait penetapan harga gas yang dinilai terlalu tinggi,” kata Syarkawi.
Atas laporan pelaku usaha terkait harga jual gas di Sumatera Utara itu, KPPU melakukan penyelidikan untuk menemukan dua alat bukti. ”Ada dugaan praktik monopoli dengan menetapkan harga jual yang terlalu tinggi,” katanya.
Syarkawi menambahkan, dari laporan pelaku usaha itu, harga jual gas mencapai 14,8 dollar AS per juta metrik british thermal unit (MMBTU). Laporan itu didasarkan pada peristiwa tahun 2015 dan dilaporkan ke KPPU pada 2016 lalu.
KPPU akan menggelar serangkaian persidangan dengan pihak terlapor, yaitu PT Perusahaan Gas Negara (PGN). Dalam proses persidangan, PT PGN akan menyampaikan tanggapan terkait laporan dugaan pelanggaran dari pelaku usaha ke KPPU tersebut.
Jika terlapor menolak dugaan pelanggaran itu, pihak terlapor harus menyampaikan bukti-bukti, saksi ahli, dan bukti petunjuk untuk memperkuat bantahan.
Terkait kasus dugaan pelanggaran itu, Sekretaris Perusahaan PT PGN Heri Yusup mengungkapkan, pihaknya menyerahkan proses tersebut kepada KPPU ”Kami ikuti aturan yang berlaku dan tunduk pada aturan,” katanya. Ia juga belum mengetahui jadwal sidang yang akan digelar KPPU ”Saya belum tahu teknisnya,” ujarnya.
Menurut Heri, persoalan harga gas yang dinilai tinggi tidak hanya terkait dengan PT PGN karena banyak pemangku kepentingan yang terlibat dalam mata rantai distribusi gas. Aturan yang mengatur masalah bisnis gas juga banyak.
