Deputy Minister of EMR: Illegal Drilling Must Be Acted



The practice of oil drilling, especially by grabbing a well that is a state asset managed by a contractor of cooperation contracts (KKKS) is a violation of Law No. 22 of 2001 on Oil and Gas so that the perpetrators must be immediately dealt with.

Therefore, Syamsir proposed a number of strategic steps to resolve the issue. First, immediately complete the revision of the Oil and Gas Draft Law as a comprehensive legal basis in the oil and gas sector. 

     Secondly, it is necessary for the commitment of the government or regional government and business entities to a comprehensive and integrative solution to the practice of illegal drilling so as not to impact the security, safety and sustainability of environmental functions. 

     Third, strict and sustained supervision is necessary so that this practice does not harm the parties.

In addition, there needs to be socialization (counseling and education) of the community for the purpose of increasing national petroleum production by reactivating old wells can be achieved, and on the other hand is not problematic with security aspects, safety and environmental function preservation.

Police Brigadier General Supriyanto Tarah, Assistant Deputy for Coordination of National Crime Handling and Crime Against State's wealth Ministry of Political, Legal and Security (Kemen Polhukham), said to curb illegal practices in the oil and gas sector need synergy among all stakeholders either Ministry of Energy and Mineral Resources, KKKS, local government, and security apparatus (TNI / Polri). Praktik pengeboran minyak apalagi dengan menyerobot sumur yang menjadi aset negara yang dikelola oleh kontraktor kontrak kerja sama (KKKS) adalah perbuatan melanggar Undang-Undang No 22 Tahun 2001 tentang Minyak dan Gas Bumi sehingga pelakunya harus segera ditindak.

Wakil Menteri Energi dan Sumber Daya Mineral (ESDM) Archandra Tahar mengatakan praktik pengeboran minyak di wilayah kerja KKKS maupun penyerbotan sumur minyak yang dikelola KKKS tidak dapat dibenarkan. 

     Sesuai UU Migas, kegiatan pengeboran minyak dilakukan oleh perusahaan yang telah menandatangani kontrak kerja sama dengan pemerintah yang dalam hal ini diwakili oleh Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas).

Yang jelas illegal drilling itu melanggar hukum. ltu dulu. Kemudian bila ada kejadian di selidiki dulu kegiatan pengeboran ilegal itu di wilayah kerja siapa. KKKS yang punya izin di wilayah itu yang harus memulai dengan lapor ke Dirjen Migas dan SKK Migas lalu bersama lakukan tindakan dengan aparat,” kata Archandra.

Ditanya tentang rencana Pemerintah Kabupaten Musi Banyuasin, Sumatera Selatan yang akan melakukan penutupan 27 sumur minyak di wilayah kerja Pertamina EP Asset 1 Field Ramba pada akhir April 2017. Archandra belum mengetahuinya. Dia mengaku belum mendapatkan laporan mengapa penutupan sumur minyak di Mangunjaya, Kecamatan BabatToman di Muba sampai diundur penertibannya.

Pelaksana Tugas Bupati Muba Yusnin sebelumnya menyatakan Pemerintah Kabupaten Muba akan melakukan penutupan 27 sumur di Wilayah kerja dan menjadi aset negara yang dikelola Pertamina EP Asset 1 Field Ramba di Mangunjaya. 

     Dari total 104 sumur minyak tua di wilayah kerja Field Ramba di Muba, sekitar 74% sudah dilakukan penyemenan oleh pihak Pertamina EP bekerja sama dengan aparat kepolisian dan TNI serta Pemkab Muba pada Oktober tahun lalu.

Penertiban dilakukan karena manajemen Pertamina EP menilai kegiatan pengeboran minyak itu melanggar hukum dan membahayakan penambang karena aktivitas itu tidak melalui standar prosedur operasi pengeboran minyak. 

     Di sisi lain, kegiatan pengeboran minyak itu juga membahayakan bagi para penambang dan juga masyarakat sekitar, selain adanya kerusakan lingkungan akibat limbah minyak yang tumpah. 

Beberapa kejadian ledakan pada sejumlah sumur minyak ilegal di luar Wilayah KKKS menimbulkan korban jiwa dan puluhan penambang terbakar.  Syamsir Abduh, Anggota Dewan Energi Nasional, mengakui bahwa praktik illegal drilling bukan hanya terkait aspek keamanan maupun sosial semata tetapi juga disebabkan adanya celah-regulasi yang memungkinkan terjadinya tindakan illegal drilling. 

     Di antara regulasi yang ditengarai berpotensi menimbulkan praktik tersebut adalah Peraturan Menteri ESDM No 01 Tahun 2008 tentang Pedoman Pengusahaan Pertambangan Minyak Bumi pada Sumur Tua.

Karena itu, Syamsir mengusulkan sejumlah langkah strategis untuk menyelesaikan persoalan tersebut. Pertama, segera menyelesaikan revisi RUU Migas sebagai landasan hukum yang komprehensif di sektor migas. 

     Kedua, perlu komitmen pemerintah atau pemerintah daerah serta badan usaha atas penyelesaian komprehensif dan integratif terhadap praktik illegal drilling agar tidak menimbulkan dampak keamanan, keselamatan dan kelestarian fungsi lingkungan hidup. 

    Ketiga, perlu pengawasan secara ketat dan berkelanjutan agar praktik ini tidak merugikan para pihak.

Selain itu, perlu adanya sosialisasi (penyuluhan dan edukasi) masyarakat agar tujuan meningkatkan produksi minyak bumi nasional dengan mereaktivasi sumur tua dapat tercapai, dan di sisi yang lain tidak bermasalah dengan aspek keamanan, keselamatan dan kelestarian fungsi lingkungan.

Brigadir Jenderal Polisi Supriyanto Tarah, Assisten Deputi Koordinasi Penanganan Kejahatan Nasional dan kejahatan Terhadap kekayaan Negara Kementerian Politik Hukum dan Keamanan (Kemen Polhukham), mengatakan untuk menertibkan praktik ilegal di sektor migas perlu sinergi di antara semua pemangku kepentingan, baik Kementerian ESDM, SKK Migas, KKKS, pemerintah daerah, dan aparat keamanan (TNI/Polri). Para pihak ini perlu bersinergi terutama dalam sosialisasi penutupan sumur minyak dan bahaya kegiatan illegal drilling.

Di sisi lain juga perlu diperhatikan aspek sosial sebagai dampak dari penutupan sumur-sumur minyak yang dikelola secara ilegal. lni perlu sinergi antara pemerintah pusat dan daerah dengan KKKS dan SKK Migas.
