Rule of Gas Flaring Sale Price Issued



The Government issues regulations on the utilization and selling price of flare gas in upstream oil and gas (oil and gas) business activities. The regulation in the Minister of Energy and Mineral Resources Regulation No. 32 of 2017 is expected to encourage the utilization of flare gas.

Arcandra said, the absence of limits on the price of flare gas caused its utilization is relatively slow. There are two types of flare gas buyers, namely entity holder of processing business license and / or natural gas business license and government agency. The buyer of flare gas will be determined through the mechanism of supply of the potential for flare gas implemented by the Upstream Oil and Gas Regulatory Agency (SKK Migas).

In the offering, SKK Migas first establishes the potential data of the flare gas to be offered to the prospective buyer. Meanwhile, the prospective buyer must submit an application to SKK Migas. The documents to be completed are the offer price, investment commitment, operating period, implementation guarantee of 1% of investment value, proof of annual tax payment, and application letter with profiles of potential buyers of flare gas.

Looking ahead to various new contracts of gas flare sales will be set based on the offer made by prospective buyers of gas. This gas flare regulation comes into force on May 8, 2017. So, what determines the price will be the producer of flare gas, "said Arcandra.

Aturan Harga Jual Gas Suar Diterbitkan


Pemerintah menerbitkan aturan mengenai pemanfaatan dan harga jual gas suar (Flare) pada kegiatan usaha hulu minyak dan gas bumi (migas). Pengaturan yang ada dalam Peraturan Menteri ESDM No 32 Tahun 2017 itu diharapkan dapat mendorong pemanfaatan gas suar.

"Harga gas suar ditetapkan paling rendah sebesar USD 0,35 per MMBTU. Itu untuk maksimal harga terendah kontrak-kontrak existing yang selama ini belum ditetapkan. Untuk harga maksimal ditetapkan sebesar USD 3,67 per MMBTU dengan dikurangi beberapa faktor koreksi yang terdiri atas kandungan CO2 dan H2S,” kata Wakil Menteri ESDM Arcandra Tahar di Kementerian ESDM

Arcandra mengatakan, tidak adanya batasan penetapan harga gas suar menyebabkan pemanfaatannya relatif lambat. Terdapat dua jenis pembeli gas suar, yakni badan usah pemegang izin usaha pengolahan dan/atau izin usaha niaga gas bumi dan lembaga pemerintah. Pembeli gas suar akan ditetapkan melalui mekanisme penawaran potensi gas suar yang dilaksanakan oleh Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas).

Di dalam penawaran itu, SKK Migas terlebih dahulu menetapkan data potensi gas suar yang akan ditawarkan kepada calon pembeli. Sementara itu, calon pembeli wajib menyampaikan permohonan kepada SKK Migas. Adapun, dokumen-dokumen yang harus dilengkapi adalah harga penawaran, komitmen investasi, jangka waktu beroperasi, jaminan pelaksanaan sebesar 1% dari nilai investasi, bukti pembayaran pajak tahunan, dan surat permohonan yang dilengkapi profil calon pembeli gas suar.

Ke depan untuk berbagai kontrak baru penjualan gas suar akan ditetapkan berdasarkan penawaran yang dilakukan calon pembeli gas. Aturan gas suar ini mulai berlaku 8 Mei 2017. Jadi, yang menentukan harga nantinya adalah penghasil gas suar," kata Arcandra.
