Borrowed Costs of the New Contractor


Oil and gas block is exhausted

The government rearranged the scheme of return on investment controls rather than oil and gas blocks that exhausted the contract to maintain production levels in the region.

Since 4 months of issuance of Minister of Energy and Mineral Resources Regulation no. 26/2017 on the Mechanism of Refund of Investment Costs on Upstream Oil and Gas Business Activities, the government revised the decision to become Minister of Energy and Mineral Resources Regulation no. 47/2017 issued on 3 August 2017.

The government changed some points in the beleid relating to the mechanism of return on investment by contractors on oil and gas blocks that have expired contract. First, the return of investment cost becomes the expense of new contractor. In contracts that move to gross split schemes, new contractors can take into account the burden of investment costs on the block of contracts into split-ups.

Second, the activities undertaken to maintain the fairness of the production level at the end of the contract period stated in the field development plan and / or work program are limited based on the approval of SKK Migas.

Third, changing the definition of investment costs. In Minister of Energy and Mineral Resources Regulation no. 26/2017, the investment cost is the budget issued by the contractor in the upstream investment activity from the beginning until the contract expires.

Meanwhile, in the new beleid, the definition of the investment cost refers only to the investment at the end of the contract period with the approval of SKK Migas. Fourth, the contractor of cooperation contract (KKKS) is required to maintain the level of oil and gas production. Fifth, there is consideration of SKK Migas regarding the level and production estimates of the investment returns made by contractors.

Deputy Minister of Energy and Mineral Resources (ESDM) Arcandra Tahar said that un-vecovered cost becomes the determinant of profit sharing in the gross split scheme. In addition, the contractor can get additional revenue sharing through the calculation of the load.

"If the gross split is calculated to increase the profit sharing of the contractor. Seen this is feasible or not. The PSC [production sharing scheme] for profit sharing as well as cost recovery and tax reduction, "he said, Friday (11/8).

He said that since Minister of Energy and Mineral Resources Regulation no. 26/2017 issue, there is a misconception. The reason, there are contractors who filed for unrecovery cost fantastic value because it is calculated from the beginning of the contract. In fact, the return on investment is only intended for efforts to maintain production at the end of the oil and gas block contract.

"There is an unrecoverable cost-starting company from initial production to new contractors, some of which mean so, but not so," he said.

BLOCK ONWJ

Meanwhile, PT Pertamina Hulu Energi President Director, Gunung Sardjono Hadi, said that his side has received a 5% split for the management of the Offshore Block North West Java (ONWJ). On a gross split contract signed on January 18, 2017, PHE ONWJ gets a 57.5% oil revenue share and 62.5% gas.

Meanwhile, with the unecovered cost burden that must be borne, it has got an additional 5% again.

"Alright. We can add 5% split, "he said.

Upstream Director of Pertamina Syamsu Alam said that with such a return scheme becomes more fair for new contractors, especially those who manage the block that has been returned to the government.

The government commissioned Pertamina to manage eight working areas that will expire its contract. The eight working areas are Tuban-East Java (JOB Pertamina-PetroChina East Java); Block Ogan Komering-South Sumatra (JOB Pertamina-Talisman); Sanga-Sanga-East Kalimantan Block (VICO); Southeast Sumatra Block (SES) -Lampung (CNOOC SES Limited); Mahakam-East Kalimantan Block (Total E & P Indonesie); Block of Attaka-East Kalimantan (Chevron); East Kalimantan Block (Chevron) and North Sumatra Offshore-Aceh Block (Pertamina).

"If it has been compensated by the addition of split, I think it is fair," he said.

Oil and Gas Upstream Analyst Wood Mackenzie Johan Utama considers that some of the new regulations issued by the ESDM Ministry have received negative responses from business actors. On the negative response, he said, the government revised some regulations. On the positive side, he mentioned that the government responded to the complaints of business actors.

On the other hand, it gives the impression that the government is in too much of a hurry to make a policy so that the result is not enough to solve the problem. Thus, perceptions that arise precisely the low stability of regulations in Indonesia.

"On the one hand, that the government is willing to listen and respond to the responses of industry players is a positive one. On the other hand, it can create the impression that these policies are less than perfect and affect perceptions about Regulatory stability, "he said.

Biaya Ditanggung Kontraktor Baru


Pemerintah mengatur ulang skema pengembalian investasi kontrol daripada blok minyak dan gas bumi yang habis kontrak untuk mempertahankan tingkat produksi di wilayah itu.

Sejak 4 bulan terbitnya Peraturan Menteri ESDM No. 26/2017 tentang Mekanisme Pengembalian Biaya investasi pada Kegiatan Usaha Hulu Minyak dan Gas Bumi, pemerintah merevisi beleid itu menjadi Peraturan Menteri  ESDM No. 47/2017 yang diterbitkan pada 3 Agustus 2017.

Pemerintah mengubah beberapa poin dalam beleid itu terkait dengan mekanisme pengembalian investasi oleh kontraktor pada blok migas yang sudah habis kontraknya. Pertama, pengembalian biaya investasi menjadi beban kontraktor baru. Pada kontrak yang beralih ke skema bagi hasil kotor (gross split), kontraktor baru bisa memperhitungkan beban biaya investasi di blok habis kontrak menjadi penambah bagi hasil (split).

Kedua, kegiatan yang dilakukan untuk menjaga kewajaran tingkat produksi pada akhir masa kontrak yang dinyatakan dalam rencana pengembangan lapangan dan atau program kerja dibatasi berdasarkan persetujuan SKK Migas.

Ketiga, pengubahan definisi biaya investasi. Pada Peraturan Menteri ESDM No. 26/2017, biaya investasi adalah anggaran yang dikeluarkan oleh kontraktor dalam kegiatan investasi hulu terhitung sejak awal hingga kontrak berakhir.

Sementara itu, dalam beleid baru, definisi biaya investasi yang dimaksud mengerucut hanya pada investasi pada akhir masa kontrak dengan persetujuan SKK Migas. Keempat, kontraktor kontrak kerja sama (KKKS) diharuskan menjaga tingkat produksi minyak dan gas bumi. Kelima, ada pertimbangan SKK Migas mengenai tingkat dan perkiraan produksi dari hasil investasi yang telah dilakukan oleh kontraktor.

Wakil Menteri Energi dan Sumber Daya Mineral (ESDM) Arcandra Tahar mengatakan bahwa beban biaya yang belum dikembalikan (un-vecovered cost) menjadi faktor penentu bagi hasil dalam skema gross split. Selain itu, kontraktor bisa mendapat tambahan bagi hasil melalui perhitungan beban tersebut.

“Kalau gross split dihitung untuk penambahan bagi hasil kontraktor. Dilihat ini feasible [layak] atau tidak. Yang PSC [skema bagi hasil produksi] bagi hasil sebagai cost recovery juga dan pengurangan pajak," ujarnya, Jumat (11/8).

Dia menuturkan bahwa sejak Peraturan Menteri ESDM No. 26/2017 terbit, terdapat kekeliruan pendefinisian. Pasalnya, terdapat kontraktor yang mengajukan unrecovery cost dengan nilai fantastis karena dihitung sejak awal kontrak. Padahal, pengembalian investasi hanya ditujukan untuk upaya-upaya mempertahankan produksi pada masa akhir kontrak blok migas.

“Ada perusahaan unrecovery cost -nya mulai dari produksi awal dimasukkan ke kontraktor baru, ada yang mengartikan begitu, tetapi maksudnya tidak begitu," katanya. 

BLOK ONWJ

Sementara itu, Presiden Direktur PT Pertamina Hulu Energi Gunung Sardjono Hadi mengatakan bahwa pihaknya telah mendapat tambahan split sebesar 5% untuk pengelolaan Blok Offshore North West Java (ONWJ). Pada kontrak gross split yang ditandatangani pada 18 Januari 2017, PHE ONWJ mendapatkan bagi hasil minyak 57,5% dan gas 62,5%.

Adapun, dengan beban unecovered cost yang harus ditanggung, pihaknya telah mendapatkan tambahan 5 % lagi. 

“Ya, sudah. Kami dapat tambahan split 5%,” katanya.

Direktur Hulu Pertamina Syamsu Alam mengatakan bahwa dengan skema pengembalian tersebut menjadi lebih adil bagi kontraktor baru terutama yang mengelola blok yang telah dikembalikan kepada pemerintah.

Pemerintah menugaskan Pertamina untuk mengelola delapan wilayah kerja yang akan habis masa kontraknya. Delapan wilayah kerja tersebut yakni Blok Tuban-Jawa Timur (JOB Pertamina-PetroChina East Java);  Blok Ogan Komering-Sumatra Selatan (JOB Pertamina-Talisman); Blok Sanga-Sanga-Kalimantan Timur (VICO); Blok Southeast Sumatera (SES)-Lampung (CNOOC SES Limited); Blok Mahakam-Kalimantan Timur (Total E&P Indonesie); Blok Attaka-Kalimantan Timur (Chevron); Blok East Kalimantan (Chevron) dan Blok North Sumatera Offshore-Aceh (Pertamina).

“Kalau sudah dikompensasi dengan penambahan split, saya kira cukup fair,” katanya.

Analis Hulu Minyak dan Gas Bumi Wood Mackenzie Johan Utama menilai, beberapa regulasi yang baru diterbitkan oleh Kementerian ESDM mendapatkan respons negatif dari pelaku usaha. Atas respons negatif itu, katanya, pemerintah melakukan revisi beberapa peraturan. Sisi positifnya, dia menyebut bahwa pemerintah merespons keluhan pelaku usaha.

Di sisi lain, hal tersebut menimbulkan kesan bahwa pemerintah terlalu terburu-buru membuat kebijakan sehingga hasilnya belum cukup menyelesaikan masalah. Dengan demikian, persepsi yang timbul justru rendahnya kestabilan regulasi di Indonesia.

“Dari satu sisi, bahwa pemerintah mau mendengarkan dan merespons tanggapan dari pelaku industri adalah yang positif. Di sisi lain, bisa menumbuhkan kesan bahwa kebijakan-kebijakan tersebut kurang sempurna dan mempengaruhi persepsi mengenai kestabilan regulasi,” katanya.
