Total Request Rejected

The Government rejected the incentives submitted by Total E & P Indonesie who are still interested in having a share of participation in oil and gas blocks whose contract expires on December 31, 2017.

Total E & P lndonesie becomes operator of oil and gas block located in East Kalimantan. However, starting January 1, 2018, PT Pertamina is appointed operator of the Mahakam Block. The government still gives the opportunity to Total and Inpex Corporation to have 30% stake in Mahakam Block participation. Currently, Total E & P lndonesie becomes operator at Mahakam block partners with Inpex with 50% share ownership interest.

The proposed incentives from Total aims to ensure the management of the Mahakam Block after the contract expires are still in accordance with the economies of scale. Deputy Minister of Energy and Mineral Resources (ESDM) Arcandra Tahar said that the government has conveyed the attitude related to the proposal of Total E & P Indonesie as the oil and gas block operator located in East Kalimantan.

All of the total proposals, such as First Tranche Petroleum (FTP) loading by 0%, investment credit and depreciation for 2 years are rejected by the government.

FTP is a tax that arises directly from oil and gas production activities before deducting the return of operating costs and handling of production. Meanwhile, investment credit is the addition of a certain amount of return on investment in accordance with a certain percentage.

Arcandra explained, the proposal is difficult to grant the government. However, he did not mention the government's consideration of rejecting the proposal from the Total.

Despite having rejected all of Total's proposals, Arcandra said that the French-based oil and gas company is still interested in mastering the remaining rights of participation in Pertamina's Mahakam Block. Pertamina and its existing contractors have received a space of ownership of the right to participate in the new Mahakam Block cooperation contract signed in 2015.

In the contract, Pertamina appointed as operator controls 70% shares, while Total and Inpex are given maximum space of 30%. However, Arcandra did not mention whether the shareholding share of participation changed.

Earlier, ESDM Minister Ignasius Jonan opened the share ownership interest space for existing contractors up to 39% with 10% assumption for local government and Pertamina which still dominate share participation.

"They are still interested in participating in this block, but please B to B [in business] with Pertamina."

According to him, the share of participation is set based on the business scheme. Furthermore, Pertamina through PT Pertamina Hulu Mahakam (PHM) remains the operator that controls majority shareholding shares.

Head of Media Communication & Relation Support Total E & P lndonesie Kristanto Hartadi said that it has indeed received a government response on the proposed incentives. According to him, a letter of response from the government has been received since the end of July 2017.

"The letter was sent on July 27, 2017," he said.

Meanwhile, related to the purchase of shares of participation for the current contractor, Pertamina Upstream Director Syamsu Alam said that it still refers to the share ownership limit of Total and Inpex 30% participation.

According to him, the discussion about shares of participation has already started both sides. However, he hopes that the transaction can be completed when the new contract is valid on January 1, 2018. There is discussion on working level, "he said.

In general, managing is running on target. One of them, in terms of labor, Syamsu said, almost entirely switch from Total to Pertamina Hulu Mahakam. The transition of labor contributes to the achievement of production targets as the Mahakam Block has been managed by Total and Inpex for about 50 years.

Based on data from the Special Unit for Upstream Oil and Gas Business (SKK Migas), Mahakam Block operated by Total E & P Indonesie, the realization of gas production until June 2017 is 1,504 MMscfd or 105% of target 1,430 MMscfd.

The Mahakam block contributes 20% to the national gas production which reaches 7.512 MMscfd. Meanwhile, the realization of oil and condensate production was 55,100 barrels per day (bpd) or 103% higher than the target of 53,600 bpd.

Permintaan Total Ditolak

Pemerintah menolak insentif yang diajukan oleh Total E & P Indonesie yang masih berminat untuk memiliki saham partisipasi di blok minyak dan gas bumi yang kontraknya akan berakhir pada 31 Desember 2017.

Total E&P lndonesie menjadi operator blok migas yang berlokasi di Kalimantan Timur. Namun, mulai 1 Januari 2018, PT Pertamina ditunjuk menjadi operator Blok Mahakam. Pemerintah masih memberikan kesempatan kepada Total dan Inpex Corporation untuk memiliki saham partisipasi Blok Mahakam maksimal 30%. Saat ini, Total E&P lndonesie menjadi operator di

Blok Mahakam bermitra dengan Inpex dengan kepemilikan saham partisipasi masing-masing 50%. 

Usulan insentif dari Total itu bertujuan menjamin pengelolaan Blok Mahakam setelah habis kontrak masih tetap sesuai dengan skala ekonomi. Wakil Menteri Energi dan Sumber Daya Mineral (ESDM) Arcandra Tahar mengatakan bahwa pemerintah telah menyampaikan sikap terkait dengan usulan dari Total E&P Indonesie sebagai operator blok minyak dan gas bumi yang berlokasi di Kalimantan Timur itu.

Semua usulan Total, seperti pembebanan First Tranche Petroleum (FTP) sebesar 0%, kredit investasi (investment credit) dan depresiasi selama 2 tahun ditolak oleh pemerintah.

FTP merupakan pajak yang timbul langsung dari kegiatan produksi migas sebelum dikurangi pengembalian biaya operasi dan penanganan produksi. Sementara itu, kredit investasi merupakan penambahan sejumlah pengembalian investasi sesuai dengan persentase tenentu.

Arcandra menjelaskan, usulan tersebut sulit dikabulkan pemerintah. Namun, dia tidak menyebutkan pertimbangan pemerintah menolak usulan dari Total tersebut.

“Tiga permintaan mereka [Total E & P Indonesie] kami tolak. Pemerintah menolak. Kami sudah sampaikan, mereka sudah menerima,” ujarnya

Kendati telah menolak semua usulan Total, Arcandra menyebut bahwa perusahaan migas yang bermarkas di Perancis itu masih berminat menguasai sisa hak partisipasi di Blok Mahakam yang dimiliki Pertamina. Pertamina dan kontraktor yang ada saat ini telah mendapat ruang kepemilikan hak partisipasi pada kontrak kerja sama baru Blok Mahakam yang diteken pada 2015.

Pada kontrak tersebut, Pertamina yang ditunjuk sebagai operator menguasai saham 70%, sedangkan Total dan Inpex diberi ruang maksimum sebesar 30%. Namun, Arcandra tidak menyebut apakah angka kepemilikan saham partisipasi berubah.

Sebelumnya, Menteri ESDM Ignasius Jonan membuka ruang kepemilikan saham partisipasi bagi kontraktor existing naik ke 39% dengan asumsi 10% untuk pemerintah daerah dan Pertamina yang masih menguasai saham partisipasi secara dominan.

“Mereka tetap berminat untuk ikut berpartisipasi dalam blok ini, tetapi silakan B to B [secara bisnis] dengan Pertamina."

Menurutnya, porsi saham partisipasi itu ditetapkan berdasarkan skema bisnis. Lebih lanjut, Pertamina melalui PT Pertamina Hulu Mahakam (PHM) tetap menjadi operator yang menguasai saham partisipasi mayoritas.

“Harus mayoritas" kata Jonan.

Head Department of Media Communication & Relation Support Total E&P lndonesie Kristanto Hartadi mengatakan bahwa pihaknya memang telah menerima respons pemerintah tentang usulan insentif tersebut. Menurutnya, surat respons dari pemerintah telah diterima sejak akhir Juli 2017. 

“lya surat dikirim tanggal 27 Juli 2017,” ujarnya.

Sementara itu, terkait dengan permbicaraan pembelian saham partisipasi bagi kontraktor saat ini, Direktur Hulu Pertamina Syamsu Alam mengatakan bahwa pihaknya masih mengacu pada batas kepemilikan saham partisipasi Total dan Inpex 30%.

Menurutnya, pembicaraan soal saham partisipasi itu sudah dimulai kedua belah pihak. Namun, dia berharap agar transaksi bisa diselesaikan ketika kontrak baru berlaku pada 1 Januari 2018. Ada pembahasan di working level," katanya.

Secara umum, alih kelola berjalan sesuai target. Salah satunya, dari sisi tenaga kerja, Syamsu menyebut, hampir seluruhnya beralih dari Total ke Pertamina Hulu Mahakam. Peralihan tenaga kerja turut berkontribusi untuk menjaga tercapainya target produksi karena Blok Mahakam telah dikelola Total dan Inpex sekitar 50 tahun.

Berdasarkan data Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas), Blok Mahakam yang dioperasikan Total E&P Indonesie, realisasi produksi gasnya hingga Juni 2017 sebesar 1.504 MMscfd atau 105% dari target 1.430 MMscfd. 

Blok Mahakam berkontribusi sebesar 20% terhadap produksi gas nasional yang mencapai 7.512 MMscfd. Sementara itu, realisasi produksi minyak dan kondensat sebesar 55.100 barel per hari (bph) atau lebih tinggi 103% dari target 53.600 bph.
