Contractor of cooperation contract (KKKS) estimates that the time limitation policy in the auction process and the contract of goods / services in the upstream oil and gas sector is difficult to realize because it still faces several obstacles.
Executive Director of Indonesian Petroleum Association (IPA) Marjolijn Wajong said that the time limits in auction process in the upstream oil and gas sector will force the contractor of cooperation contract (KKKS) to work more efficiently. However, in the process of auction of goods / services and the issuance of contracts, there are obstacles that can not be controlled either by KKKS or Special Working Unit of Upstream Oil and Gas Business Activities (SKK Migas).
For example, Marjolijn Wajong mentioned the complex auction implementation and participants of more than 30 companies would take longer. The complicated auctions took place in the procurement of project defining and construction services and the procurement of oil and gas drilling installations (rigs).
Based on the Working Procedure Manual (PTK) Revision 04, the goods auction is limited to 60 working days, 120 days service auction, and 30 days maximum contract issuance.
"For a complex tender such as an EPCI tender [engineering procurement, construction, and installation] or tender rig or tender with a large number of participants, more than 30 participants will be difficult to fulfill by KKKS," Marjolijn Wajong said.
In addition there are obstacles to realize the process of contract issuance for 30 working days due to frequent exceptions and goods providers. The proposed objections are mostly related to commercial matters, insurance, and liability for clauses established by the contractor.
To be able to issue contracts, KKKS and vendors must negotiate, sometimes longer than the auction process of the goods or services used. Thus, the 30-day contract issuance boundary is difficult to achieve when contractors and vendors still have a long list of points to negotiate.
Previously, Head of Procurement Management Division of Goods and Services SKK Migas Erwin Suryadi said the acceleration of the time frame of the tender implementation is done by stipulating the deadline of the tender implementation and the issuance of the contract.

Tender Hulu Migas Semakin Sulit
Kontraktor kontrak kerja sama (kkks) memperkirakan kebijakan pembatasan waktu dalam proses lelang dan kontrak barang/jasa di sektor hulu minyak dan gas bumi sulit direalisasikan karena masih menghadapi beberapa kendala.
Direktur Eksekutif Indonesian Petroleum Association (IPA) Marjolijn Wajong mengatakan bahwa pembatasan waktu dalam proses lelang di sektor hulu minyak dan gas bumi akan memaksa kontraktor kontrak kerja sama (KKKS) untuk bekerja lebih efisien. Namun, dalam proses lelang barang/jasa dan penerbitan kontrak, terdapat kendala yang tidak bisa dikendalikan baik oleh KKKS maupun Satuan Kerja Khusus Peiaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas).
Sebagai contoh, Marjolijn Wajong menyebut pelaksanaan lelang yang rumit dan peserta lebih dari 30 perusahaan tentu membutuhkan waktu lebih lama. Lelang yang rumit itu terjadi dalam pengadaan jasa pendefinisian dan konstruksi proyek serta pengadaan instalasi pengeboran migas (rig).
Berdasarkan Pedoman Tata Kerja (PTK) Revisi 04, lelang barang dibatasi prosesnya hingga 60 hari kerja, lelang jasa 120 hari kerja, dan penerbitan kontrak maksimum 30 hari kerja.
“Untuk tender yang kompleks seperti tender EPCI [engineering procurement, construction, and installation] atau tender rig atau tender dengan peserta yang banyak, lebih dari 30 peserta, maka hal ini akan sulit dipenuhi oleh KKKS,” kata Marjolijn Wajong.
Selain itu terdapat hambatan untuk merealisasikan proses penerbitan kontrak selama 30 hari kerja karena sering muncul eksepsi dan penyedia barang. Sanggahan yang diajukan sebagian besar terkait soal hal komersial, asuransi, dan tanggung jawab atas klausul yang telah ditetapkan kontraktor.
Untuk bisa menerbitkan kontrak, KKKS dan vendor harus melakukan negosiasi yang terkadang prosesnya lebih panjang daripada proses lelang barang atau jasa yang digunakan. Dengan demikian, batas penerbitan kontrak 30 hari sulit dicapai ketika kontraktor dan vendor masih memiliki daftar panjang poin yang harus dinegosiasikan.
Sebelumnya, Kepala Divisi Pengelolaan Pengadaan Barang dan Jasa SKK Migas Erwin Suryadi mengatakan, percepatan tata waktu pelaksanaan tender dilakukan dengan menetapkan batas waktu pelaksanaan tender serta penerbitan kontrak.
