Oil Field Was Snatched, Pertamina Asked for Protection of Apparatus



Pertamina asked the security apparatus to handle the activities of grabbing and drilling oil that became state-owned assets. The reason, the petitioning and drilling of oil on state-owned assets managed by contractors of cooperation contracts (KKKS) is unlawful, especially Law (Act) No 22 of 2001 on Oil and Gas. Under the Oil and Gas Law, the threat against violators of the Oil and Gas Law is a five-year sentence and a fine of up to Rp 60 billion.

"If it is against the law, the duty of the security apparatus to handle the activities of grabbing and drilling of oil that become state-owned assets," said Syamsu Alam, Upstream Director of PT Pertamina.

According to Syamsu, KKKS is the owner of a working area granted the right to manage the state-owned work area. However, the KKKS can not secure all the assets of the country, especially securing oil wells that are located scattered.

"This is a national vital object (obvitnas) which also requires security assistance from related security apparatuses," he said.

According to him, KKKS as an investor duty to drill oil and gas. Investors really do not have to mess around with social issues such as cases of illegal logging and drilling of oil wells by illegal miners. But the fact is there are parties who violate by drilling the well in a wild and therefore should apparatus catch the culprit.

"We have to ask for help to law enforcement to overcome the problem. We can not face the community. After all, it is impossible to wait 24 hours for the well. Thinking oil out also feels half dead, "he said.

The practice of grabbing and drilling for oil in state-run wells managed by KKKS is again widespread. In Jambi, after closure of more than 40 KKKS oil wells, several wells were reopened by illegal miners. The same thing happened in Musi Banyuasin Regency, South Sumatra.

Despite the South Sumatra Governor's Decree No. 731 / KPTS / DESDM / 2017 dated November 13, 2017 concerning the acquisition and closure of oil wells in Mangunjaya, Musi Banyuasin located in the working area of ​​Pertamina EP Asset 1 Field Ramba (a subsidiary of PT Pertamina EP), efforts to open the well by illegal miners again occurred.

In fact, armed with the Decree, the Integrated Sub-Team of Takeover and Closing of Oil Well in Mangunjaya led by Muba Police Chief AKBP Rahmat Hakim closed 20 oil wells in Mangunjaya on 21 November. A day later, two reopened wells were forcibly opened by illegal miners.

In total there are 104 state-owned oil wells in Musi Banyuasin within the working area of ​​Pertamina EP Asset 1 Field Ramba. In November 2016 a closure of 70 wells in Mangunjaya and Keluang, Musi Banyuasin was conducted.

Furthermore, April 2017 there are 17 wells closed and the last 17 wells on 21 November, although eventually the number increased to 20 wells because there are three wells that have been closed in the closing period previously opened by illegal miners.

Deputy Minister of Energy and Mineral Resources Arcandra Tahar supports Pertamina's move requiring the security forces to be consistent in upholding the law against perpetrators of the state oil exploration and drilling process managed by KKKS. The illegal harvesting and drilling of oil wells violates the Oil and Gas Law.

"The law must still be implemented whatever it is because illegal drilling is illegal. For that, the state must run what should be run, "he said.

Separately, Amin Sunaryadi, Head of SKK Migas, when met after the inauguration of the Elephant Development Project in Muara Enim, said SKK Migas oversees and supervises the KKKS operational activities. In the case of oil wells in the working area of ​​Pertamina EP Asset 1 Field Ramba, according to Amien, SKK Migas in cooperation with KKKS requested the assistance of the police and the Indonesian National Army (TNI).

"Technically, for the closure of wells done by KKKS and SKK Migas, while for security from the apparatus," he said.

Related to the existence of illegal miners trying to open wells that have been closed the KKKS party, Amien said, the settlement must be done practically and conceptionally. Conceptually there needs to be an increase in the general welfare of the local people. Local governments can cooperate with KKKS in improving community welfare.

"There is funding from CSR, there is also that can be caused through PPO (program supporting the operation) that enter cost recovery," he said.

Lapangan Minyak Diserobot, Pertamina Minta Perlindungan Aparat


Pertamina meminta aparat keamanan untuk menangani kegiatan penyerobotan dan pengeboran minyak yang menjadi asset milik negara. Pasalnya, penyerobotan dan pengeboran minyak pada asset milik negara yang dikelola oleh kontraktor kontrak kerja sama (KKKS) adalah tindakan melawan hukum, terutama Undang-Undang (UU) No 22 Tahun 2001 tentang Minyak dan Gas Bumi. Sesuai UU Migas, ancaman terhadap pelaku pelanggar UU Migas adalah pidana lima tahun dan denda hingga Rp 60 miliar.

“Bila sudah melawan hukum, tugas aparat keamanan untuk menangani kegiatan penyerobotan dan pengeboran minyak yang menjadi asset milik negara,” ujar Syamsu Alam, Direktur Hulu PT Pertamina.

Menurut Syamsu, KKKS adalah pemilik wilayah kerja yang diberi hak mengelola wilayah kerja milik negara. Namun, KKKS tidak bisa mengamankan seluruh aset negara tersebut, terutama mengamankan sumur-sumur minyak yang lokasinya bertebaran. 

“Ini objek vital nasional (obvitnas) yang juga memerlukan bantuan pengamanan dari aparat keamanan terkait,” ujarnya.

Menurut dia, KKKS sebagai investor bertugas mengebor minyak dan gas bumi. Investor sebenarnya tidak perlu lagi dipusingkan dengan masalah sosial seperti kasus penyerobotan dan pengeboran sumur minyak oleh penambang liar. Namun faktanya ada pihak-pihak yang melanggar dengan mengebor sumur secara liar dan karena itu semestinya aparat menangkap pelakunya.

“Kami harus minta bantuan kepada penegak hukum untuk mengatasi masalah itu. Kami tidak mungkin berhadapan dengan masyarakat. Lagipula, tidak mungkin menunggu sumur 24 jam. Memikirkan minyak keluar juga rasanya setengah mati,” ujar dia.

Praktik penyerobotan dan pengeboran minyak pada sumur milik negara yang dikelola KKKS kembali marak. Di Jambi, setelah dilakukan penutupan pada lebih dari 40 sumur minyak milik KKKS, beberapa sumur kembali dibuka oleh penambang liar. Hal serupa terjadi di Kabupaten Musi Banyuasin, Sumatera Selatan. 

Kendati ada Surat Keputusan Gubernur Sumatra Selatan No. 712/KPTS/DESDM/2017 tanggal 13 November 2017 mengenai pengambilalihan dan penutupan sumur minyak di Mangunjaya, Musi Banyuasin yang berada di wilayah kerja Pertamina EP Asset 1 Field Ramba (anak usaha PT Pertamina EP), upaya membuka sumur oleh penambang liar kembali terjadi. 

Padahal, berbekal Surat Keputusan tersebut, Sub Tim Terpadu Pengambilalihan dan Penutupan Sumur Minyak di Mangunjaya yang dipimpin Kapolres Muba AKBP Rahmat Hakim menutup 20 sumur minyak di Mangunjaya pada 21 November. Selang sehari kemudian, dua sumur yang sudah ditutup kembali dibuka paksa oleh para penambang liar.

Total ada 104 sumur minyak milik negara di Musi Banyuasin yang berada dalam wilayah kerja Pertamina EP Asset 1 Field Ramba. Pada November 2016 dilakukan penutupan pada 70 sumur di Mangunjaya dan Keluang, Musi Banyuasin . 

     Selanjutnya, April 2017 ada 17 sumur yang ditutup dan terakhir 17 sumur pada 21 November, kendati akhirnya jumlahnya bertambah menjadi 20 sumur karena ada tiga sumur yang telah ditutup pada periode penutupan sebelumnya dibuka oleh penambang liar.

Wakil Menteri ESDM Arcandra Tahar mendukung langkah Pertamina yang meminta aparat keamanan konsisten dalam menegakkan hukum terhadap pelaku penyerobotan dan pengeboran sumur minyak negara yang dikelola oleh KKKS. Kegiatan penyerobotan dan pengeboran sumur minyak secara liar melanggar Undang-Undang Migas.

“Hukum tetap harus dijalankan apa pun itu karena illegal drilling merupakan ilegal. Untuk itu, negara harus menjalankan apa yang semestinya dijalankan,” ujarnya.

Secara terpisah, Amin Sunaryadi, Kepala SKK Migas, saat ditemui usai peresmian Proyek Pengembangan Paku Gajah di Muara Enim, mengatakan SKK Migas mengawal dan mengawasi kegiatan operasional KKKS. Dalam kasus penyerbotan sumur minyak yang berada di wilayah kerja Pertamina EP Asset 1 Field Ramba, menurut Amien, SKK Migas bekerja sama dengan KKKS meminta bantuan polisi dan Tentara Nsiaonal Indonesia (TNI). 

“Secara teknis, untuk penutupan sumur dilakukan oleh KKKS dan SKK Migas, sedangkan untuk pengamanan dari aparat,” ujarnya.

Terkait masih adanya penambang liar yang berupaya membuka sumur yang sudah ditutup pihak KKKS, Amien mengatakan, penyelesaiannya harus dilakukan secara praktikal dan konsepsional. Secara konsepsional perlu ada peningkatan kesejahteraan umum bagi masyarakat setempat. Pemerintah daerah bisa bekerja sama dengan KKKS dalam kegiatan peningkatan kesejahteraan masyarakat. 

“Ada dana dari CSR, ada juga yang bisa dibebabkan melalui PPO (program penunjang operasi) yang masuk cost recovery,” katanya.
