Gross Split Rules Cancel Revised Again



    The Ministry of Energy and Mineral Resources (ESDM) canceled the tax rules on profit sharing contracts or gross split. This step is to maintain investment certainty.

    Deputy Minister of Energy and Mineral Resources Arcandra Tahar said the current gross split rules are sufficient, so there is no need to add new points.

"Gross split we've evaluated again, does not seem to need to be revised," said Arcandra.

    The current regulation on gross splits has been set forth in the Regulation of the Minister of Energy and Mineral Resources No. 52/2017 on Amendment or Regulation of the Minister of Energy and Mineral Resources. 08 Year 2017 About Gross Split Revenue Contract.

    Previously, it was rumored that the Ministry of Energy and Mineral Resources plans to revise again for the second time against the regulation. The goal is to align the tax rules on gross splits.

    However, the ESDM Ministry annulled the move because the rules related to the addition of split are clearly stated in the applicable Government Regulation (PP). As a result, the Ministry of Energy and Mineral Resources argues no longer need to add a special clause in the Ministerial Regulation of gross split oil and gas.

    The Government has also issued Government Regulation no. 53/2017 on Tax Treatment on Upstream Oil and Gas Business Activities and Production Sharing Contracts Gross Split. The tax code is effective as of December 28, 2017. 

     Under the regulation, the government regulates the taxation facilities in the period of exploitation which may be provided by the government. Provision of such incentives is based on the economic aspect in the form of additional profit sharing for the contractor.

    In addition, the government regulates the loss of carry forward for ten years. And indirect tax exemption up to the first oil and gas production.

    Archandra stated that the additional share of oil and gas revenue sharing will be determined based on the discretion of the Minister of Energy and Mineral Resources. With the decision, the government hopes to provide legal certainty, so as to increase investment in the oil and gas sector.

Aturan Gross Split Batal Direvisi Lagi


    Kementerian Energi dan Sumber Daya Mineral (ESDM) batal mengubah aturan pajak soal kontrak bagi hasil atau gross split. Langkah ini untuk menjaga kepastian investasi.

    Wakil Menteri ESDM Arcandra Tahar mengatakan, aturan gross split yang berlaku saat ini sudah cukup, sehingga tidak perlu ada penambahan poin-poin baru Iagi.

"Gross split sudah kami evaluasi lagi, kelihatannya tidak perlu direvisi," kata Arcandra.

    Aturan tentang gross split yang berlaku saat ini telah tercantum dalam Peraturan Menteri ESDM No 52/2017 tentang Perubahan atau Peraturan Menteri ESDM No. 08 Tahun 2017 Tentang Kontrak Bagi Hasil Gross Split.

    Sebelumnya, beredar kabar Kementerian ESDM berencana merevisi kembali untuk kedua kali terhadap regulasi tersebut. Tujuannya untuk menyelaraskan aturan pajak tentang gross split.

    Namun, Kementerian ESDM menganulir langkah tersebut karena aturan terkait penambahan split dinilai sudah jelas tercantum dalam Peraturan Pemerintah (PP) yang berlaku. Alhasil, Kementerian ESDM berpendapat tidak perlu lagi penambahan klausul khusus dalam Peraturan Menteri gross split migas.

    Pemerintah juga telah mengeluarkan Peraturan Pemerintah No. 53/2017 tentang Perlakuan Perpajakan Pada Kegiatan Usaha Hulu Minyak dan Gas Bumi dan Kontrak Bagi Hasil Gross Split. Aturan pajak tersebut berlaku sejak diundangkan pada 28 Desember 2017. 

    Dalam aturan tersebut, pemerintah mengatur tentang fasilitas perpajakan di masa eksploitasi yang dapat diberikan oleh pemerintah Pemberian insentif tersebut berdasarkan aspek keekonomian berupa tambahan bagi hasil bagi kontraktor.

    Selain itu, pemerintah mengatur tentang loss carry forward selama sepuluh tahun. Dan pembebasan pajak tidak langsung (indirect tax) sampai dengan ada produksi migas pertama kali.

    Archandra menyatakan, penambahan porsi bagi hasil migas akan ditentukan berdasarkan diskresi dari Menteri ESDM. Dengan keputusan tersebut, pemerintah berharap dapat memberi kepastian hukum, sehingga dapat meningkatkan investasi di sektor minyak dan gas.
