"The change is in order to increase state revenues on upstream oil and gas business activities by considering the greatest benefits for the country," said Head of Communications, Public Information and Cooperation Service of the Ministry of ESDM Agung Pribadi in Jakarta.
Previously, the Minerals of Energy and Mineral Resources (ESDM) abolished the provisions on the amount of the upper limit of the signature bonus of the oil and gas blocks that would terminate their cooperation contracts for further management. The revised upper limit was previously US $ 250 million.
This provision is based on Minister of Energy and Mineral Resources Regulation no. 28 of 2018 on Amendment to Regulation of the Minister of Energy and Mineral Resources Number 23 Year 2018 on Management of Working Areas of Oil and Gas that Will End the Contract of Cooperation. The latest Beleid was enacted on May 7, 2018.
In this latest regulation, there is a change to the provisions of article 12 regarding the amount of signature bonuses. Meanwhile in chapter 12 on the old rules, the signature bonus limit is set at least US $ 1 million and at most US $ 250 million.
Agung said it can not yet confirm how much potential increase in state revenues in the presence of this latest provision. Because the evaluation team is still doing the calculations gradually. This is because there are 22 oil and gas blocks that will expire during 2019-2026. But of that number has been 4 blocks terminated in 2019 has been decided. This means that the remaining 18 oil and gas blocks will be terminated and not yet decided.

In the framework of determining the management of terminating oil and gas blocks, a Team comprising representatives of the ESDM Ministry and other related agencies shall be established. Separately, Energy Observer Pri Agung Rakhmanto from Trisakti University appreciated the government's step in evaluating the regulation. According to him, the upper limit of US $ 250 million is not comparable with large oil and gas blocks, aka the signature bonus becomes smaller. With the removal of the upper limit, the signature bonus will adjust to the characteristics of the oil and gas blocks.

But Pri Agung reminded the signature bonus should not be a benchmark government in increasing state revenues. According to him, increasing production is the main thing in increasing state revenue. Penghapusan Batas Atas Signature Bonus Dorong Pendapatan Negara
Kebijakan pemerintah menghapus ketentuan mengenai besaran batas atas pada signature bonus blok minyak dan gas bumi, memungkinkan negara pendapat penerimaan negara Iebih besar.
“Perubahan itu dalam rangka meningkatkan penerimaan negara pada kegiatan usaha hulu migas dengan mempertimbangkan manfaat yang sebesar-besarnya bagi negara,” kata Kepala Biro Komunikasi, Layanan Informasi Publik dan Kerja Sama Kementerian ESDM Agung Pribadi di Jakarta.
Sebelumnya, Kementerian-kementerian Energi dan Sumber Daya Mineral (ESDM) menghapus ketentuan mengenai besaran batas atas bonus tanda tangan (signature bonus) blok minyak dan gas bumi yang akan berakhir kontrak kerjasamanya untuk dikelola selanjutnya. Adapun batas atas yang direvisi itu sebelumnya sebesar US$ 250 juta.
Ketetapan ini berdasarkan Peraturan Menteri ESDM No. 28 tahun 2018 tentang Perubahan atas Peraturan Menteri ESDM Nomor 23 Tahun 2018 tentang Pengelolaan Wilayah kerja Minyak dan Gas Bumi yang Akan Berakhir Kontrak Kerjasamanya. Beleid terbaru ini diundangkan pada 7 Mei 2018 lalu.
Pada peraturan terbaru ini, terdapat perubahan pada ketentuan pasal 12 mengenai besaran bonus tanda tangan. Pada pasal itu disebutkan bonus tanda tangan paling sedikit adalah sebesar US$ 1 juta, dan tidak ada besaran paling banyak. Sementara itu di pasal 12 pada aturan lama, batas bonus tanda tangan ditetapkan paling sedikit US$ 1 juta dan paling banyak US$ 250 juta.
Agung menuturkan pihaknya belum bisa memastikan berapa potensi peningkatan penerimaan negara dengan adanya ketentuan terbaru ini. Pasalnya tim evaluasi masih melakukan perhitungan secara bertahap. Hal ini mengingat terdapat 22 blok migas yang akan berakhir masa kontraknya sepanjang 2019-2026. Namun dari jumlah itu sudah 4 blok yang terminasi di 2019 sudah diputuskan. Artinya tersisa 18 blok migas yang akan terminasi dan belum diputuskan.
“Evaluasi yang paling dekat itu terminasi 2020. Tapi proses masih berlangsung,” jelasnya.
Dalam rangka penetapan pengelolaan blok migas terminasi dapat dibentuk Tim yang beranggotakan Wakil dari Kementerian ESDM dan instansi lain yang terkait. Tim tersebut melakukan evaluasi dan penilaian besaran bonus tandatangan terhadap pengelolaan blok migas terminasi selanjutnya. Besaran bonus tandatangan tersebut ditetapkan menggunakan formula yang ditetapkan berdasarkan Keputusan Menteri ESDM.
Dikatakannya berdasarkan Peraturan Menteri ESDM 28/2018 ditetapkan pengelolaan blok migas yang kontraknya berakhir dapat dilakukan melalui perpanjangan oleh kontraktor eksisting, pengelolaan oleh Pertamina, pengelolaan bersama antara kontraktor dan Pertamina serta di lelang. Menurutnya yang terpenting dalam pengelolaan blok migas terminasi adalah program kerja untuk kelanjutan pengelolaannya harus dijaga kualitas dari aspek kemampuan teknis maupun finansial dan harus tetap memberikan hasil yang Iebih besar bagi negara.
“Kalau hasilnya lebih besar, penerimaan negara juga lebih baik, manfaat untuk negara juga makin besar,” ujarnya.
Secara terpisah, Pengamat energi Pri Agung Rakhmanto dari Universitas Trisakti mengapresiasi langkah pemerintah mengevaluasi peraturan. Dia menilai tidak tepat adanya ketentuan besaran batas atas signature bonus. Menurutnya batas atas US$ 250 juta tidak sebanding dengan blok migas besar alias nilai signature bonus menjadi lebih kecil. Dengan penghapusan batas atas maka bonus tanda tangan akan menyesuaikan dengan karakteristik blok migas.
“Peraturan baru itu dilihatnya harus utuh. Sebelumnya pemerintah menerbitkan batas atas, ini tidak benar. Sekarang batas atas dihapus. ini benar,” ujarnya.
Namun Pri Agung mengingatkan signature bonus jangan menjadi patokan pemerintah dalam meningkatkan penerimaan negara. Menurutnya peningkatan produksi merupakan hal yang utama dalam meningkatkan penerimaan negara. Dia menegaskan penghapusan batas atas bonus tanda tangan bisa saja meningkatkan penerimaan negara. Tetapi juga bisa saja sebaliknya.
“Besar kecilnya signature bonus dari keekonomian lapangan dan ketertarikan investor terhadap lapangan migas. Kalau investor tertarik dan lapangannya besar, tentu saja pantas signaturenya besar,” jelasnya.
Tim tersebut melakukan evaluasi dan penilaian besaran bonus tandatangan terhadap pengelolaan blok migas terminasi selanjutnya. Besaran bonus tandatangan tersebut ditetapkan menggunakan formula yang ditetapkan berdasarkan Keputusan Menteri ESDM.
