PGN claims to have tried a non-court line to ask for $ 32 million in compensation.
PT Perusahaan Gas Negara Tbk will take legal action to resolve the dispute over the non-fulfillment of gas delivery agreement with Petronas Carigali Muriah Ltd. The company will sue for compensation of US $ 32 million or equivalent to Rp 450 billion.
At the beginning of this lawsuit, PGN's subsidiary, PT Kalimantan Jawa Gas (KJG), did not get the gas supply under the Gas Transportation Agreement (GTA) agreement from Petronas Carigali Mariah Ltd. PGN believes that Petronas can not fulfill the gas distribution for Kalija Phase I transmission pipeline. In the agreement, Petronas must transfer the amount of gas to Kalija I Pipe by 104 MMSCFD from 2015 to 2019 with ship or pay decision. Terms of ship or pay is a form of guarantee on investment that must be paid.
Muriah Block Petronas
If Petronas does not distribute 104 mmscfd of gas from 2015 to 2019, Petronas must pay the KJG. In fact, the realization of Petronas distribution since 2015-2017 is always less or below 104 mmscfd. In fact, until mid-June 2018, Petronas Carigali Muriah did not immediately make any compensation payments. In accordance with the mechanism of contract ship or pay between Petronas to PT Kalimantan Java Gas (KJG) reaches approximately US $ 32 million.
Director of PGN Infrastructure and Technology Dilo Seno Widagdo said that his side will solve the compensation problem through legal channels.
"Petronas has not paid according to the terms of the GTA contract, so we will continue to arbitase," said Dilo.
According Dilo, PGN must take the path of arbitration because it has made efforts to ask for compensation from Petronas but it did not work.
"All efforts out of court have been tried, now 'we demand to the court," he said.
Petronas party is still silent about this case. Manager of Corporate Affairs & Administration Petronas Carigali Andiono Setiawan did not reply to KONTAN's short message sent on Sunday (24/6) when asked to respond to PGN's steps demanding compensation to the arbitration tribunal.
Petronas at the beginning of this year has declared a force majeure in Lapangan Kepodang Blok Muriah. Therefore Kepodang field production is incompatible with Plan of Development (POD) and unable to meet gas supply to PGN according to GTA.
In the Petronas PoD approved by SKK Migas in 2012, Kepodang Field is projected to produce up to 2026. This projection is in accordance with the number of hydrocarbons in Kepodang Field which can be produced into gas of 354 billions of standard cubic feet (bscf) of gas.
However, the calculation result of Lemigas analysis at the end of 2017 shows that gas reserve in place in Kepodang Field is only 107 bscf. While in house analysis Petronas calculated reserves of only 94 bscf. So the production of gas field Kepodang not fit the target. In POD, Kepodang Field gas production is estimated at 116 mmscfd, but now the Kepodang Field gas production is only 70-80 mmscfd.

PGN Gugat Petronas Kasus Kahar Kepodang
PGN mengklaim sudah mencoba jalur non pengadilan untuk minta ganti rugi US$ 32 juta.
PT Perusahaan Gas Negara Tbk akan menempuh jalur hukum untuk menyelesaikan sengketa atas tidak terpenuhinya perjanjian pengiriman gas dengan Petronas Carigali Muriah Ltd. Perusahaan ini akan menggugat ganti rugi sebesar US$ 32 juta atau setara Rp 450 miliar.
Awal mula gugatan ini karena anak usaha PGN yakni PT Kalimantan Jawa Gas (KJG), tidak mendapatkan pasokan gas sesuai perjanjian Gas Transportation Agreement (GTA) dari Petronas Carigali Mariah Ltd. PGN menilai Petronas tidak bisa memenuhi penyaluran gas untuk Pipa transmisi Kalija Fase I. Dalam perjanjian itu, Petronas wajib mengalirkan jumlah gas ke Pipa Kalija I sebesar 104 MMSCFD kurun waktu dari 2015 sampai 2019 dengan ketetapan ship or pay. Ketentuan ship or pay yaitu bentuk penjaminan atas investasi yang harus dibayarkan.
Jika Petronas tidak menyalurkan gas 104 mmscfd dari 2015 sampai 2019, Petronas harus membayar kepada KJG. Pada kenyataannya, realisasi penyaluran Petronas sejak 2015-2017 selalu kurang atau di bawah 104 mmscfd. Faktanya, hingga pertengahan Juni 2018, Petronas Carigali Muriah tidak segera melakukan pembayaran ganti rugi. Sesuai mekanisme kontrak ship or pay antara Petronas kepada PT Kalimantan Jawa Gas (KJG) mencapai sekitar US$ 32 juta.
Direktur Infrastruktur dan Teknologi PGN Dilo Seno Widagdo mengungkapkan, pihaknya akan menyelesaikan permasalahan ganti rugi tersebut melalui jalur hukum.
"Petronas belum membayar sesuai ketentuan kontrak GTA. Ya kami lanjutkan ke arbitase," kata Dilo.
Menurut Dilo, PGN harus menempuh jalur arbitrase karena telah melakukan upaya meminta ganti rugi dari Petronas tapi tidak berhasil.
"Semua upaya di luar pengadilan sudah kami coba, sekarang 'kami tuntut ke pengadilan," tegasnya.
Pihak Petronas sampai saat ini masih bungkam soal kasus ini. Manager Corporate Affairs & Administration Petronas Carigali Andiono Setiawan tidak menjawab pesan singkat yang dikirimkan KONTAN pada Minggu (24/6) saat diminta menanggapi langkah PGN yang menuntut ganti rugi hingga pengadilan arbitrase.
Petronas pada awal tahun ini telah menyatakan kondisi kahar di Lapangan Kepodang Blok Muriah. Makanya produksi lapangan Kepodang tidak sesuai dengan Plan of Development (POD) dan tidak mampu memenuhi pasokan gas kepada PGN sesuai GTA.
Dalam PoD Petronas yang disetujui SKK Migas pada 2012, Lapangan Kepodang diproyeksi bisa berproduksi hingga 2026. Proyeksi ini sesuai jumlah hidrokarbon di Lapangan Kepodang yang bisa diproduksikan menjadi gas sebesar 354 billions of standard cubic feet (bscf) gas.
Namun hasil perhitungan analisa Lemigas pada akhir 2017 lalu menunjukan cadangan gas in place di Lapangan Kepodang hanya 107 bscf. Sementara in house analysis Petronas menghitung cadangannya hanya 94 bscf. Makanya produksi gas Lapangan Kepodang tidak sesuai target. Dalam POD, produksi gas Lapangan Kepodang diperkirakan 116 mmscfd, tapi saat ini produksi gas Lapangan Kepodang hanya berkisar 70-80 mmscfd.
