Deputy Minister of EMR, Archandra Tahar revealed the reason for the government to set a lower limit because it refers to exploration blocks. The Contractor of Cooperation Contract (KKKS) working on the exploration block is still in the process of finding new oil and gas reserves with high risk of not getting oil reserves.
"So the government still provides a minimum limit of US $ 1 million," said Arcandra, last weekend.

Abolition of the upper limit of signature bonuses is also supported by Reforminer Institute Founder Pri Agung Rakhmanto who mentions the government's move to remove the upper limit of signature bonuses is very good. However, Executive Director of Indonesian Petroleum Association (IPA) Marjolijn Wajong did not answer confirmation whether KKKS would pay more than US $ 250 million. But what She must have said, about the termination block is the authority of the government to decide.

Kementerian Energi dan Sumber Daya Mineral (ESDM) mengincar signature bonus alias bonus tandatangan dari blok-blok besar yang kontraknya akan segera berakhir. Untuk itu, besaran signature bonus yang tadinya maksimal US$ 250 juta, kini dihapus. Jadi tidak ada batasan jumlah signature bonus yang wajib dibayar.
Langkah ini setelah Kementerian ESDM mengubah aturan soal signature bonus dengan menerbitkan Peraturan Menteri ESDM No. 28/2018 tentang Perubahan atas Peraturan Menteri ESDM Nomor 23/2018 tentang Pengelolaan Wilayah kerja Minyak dan Gas Bumi yang Akan Berakhir Kontrak Kerjasamanya yang diundangkan pada 7 Mei 2018. Meski menghapus batas atas bonus tanda tangan sebesar US$ 250 juta, atas bawah tetap sama yaitu bonus tanda tangan minimal US$ 1 juta.
Wakil Menteri ESDM, Archandra Tahar mengungkapkan alasan pemerintah menetapkan batas bawah karena merujuk pada blok-blok eksplorasi. Kontraktor Kontrak Kerjasama (KKKS) yang mengerjakan blok eksplorasi masih dalam tahapan mencari cadangan migas baru dengan resiko tinggi tidak mendapatkan cadangan minyak.
"Makanya pemerintah masih memberikan batas bawah minimal US$ 1 juta," ujar Arcandra, akhir pekan lalu.
Sementara untuk penghapusan batas atas, pemerintah menghitung kemungkinan adanya bonus tanda tangan yang bisa lebih besar dari US$ 250 juta.
"Karena mungkin ada yang lebih besar dari US$ 250 juta maka batas atasnya dilepas,"jelasnya.
Apalagi sejumlah blok besar akan habis kontrak dalam lima tahun mendatang. Sejauh ini memang ada beberapa blok terminasi. Seperti Blok Rokan (Chevron) yang akan terminasi pada tahun 2021. Blok Corridor (ConocoPhilips) yang akan terminasi pada tahun 2023 dan Blok Jabung (PetroChina) yang akan habis masa kontraknya juga pada tahun 2023.
Sementara itu, pemerintah mencatat pembayaran bonus tanda tangan yang paling besar yang pernah ditetapkan pemerintah hanya sebesar US$ 41 juta untuk Blok Mahakam yang dibayar PT Pertamina. Perhitungannya pun hanya berdasarkan data bonus tanda tangan sebelumnya.
Ingin dapat besar
Dengan tidak adanya batas atas bonus tanda tangan, Kepala Biro Komunikasi, Layanan Informasi Publik dan Kerja Sama Kementerian ESDM Agung Pribadi menyebutkan menilai penerimaan negara berpeluang lebih besar.
"Perubahan itu dalam rangka meningkatkan penerimaan negara pada kegiatan usaha hulu migas dengan mempertimbangkan manfaat yang sebesar besarnya bagi negara," kata Agung.
Penghapusan batas atas bonus tanda tangan juga didukung oleh Pendiri Reforminer Institute Pri Agung Rakhmanto yang menyebut langkah pemerintah menghapus batas atas bonus tanda tangan sudah sangat bagus. Pasalnya batas atas bonus tanda tangan tidak akan cocok untuk blok-blok migas skala besar. Selain itu, besar kecilnya bonus tanda tangan memang seharusnya tidak dibuat sama. Biarpun di sisi lain tidak lantas memperpanjang birokrasi, namun juga memerlukan proses negosiasi dan tawar menawar dalam hal harga atau keekonomian.
Menurut dia, besar kecilnya signature bonus pada dasarnya adalah fungsi dari skala keekonomian lapangan. Juga mencerminkan posisi tawar kita secara relatif dengan investor.
"Kalau kecil, ya berarti mengindikasikan minat investor secara relatif terhadap blok tersebut sebenarnya biasa-biasa saja dan kita di posisi yang tidak bisa terlalu menawar tinggi," jelas Pria Agung.
Namun, Direktur Eksekutif Indonesian Petroleum Association (IPA) Marjolijn Wajong tidak menjawab konfirmasi apakah KKKS bersedia membayar lebih dari US$ 250 juta. Namun yang pasti Ia pernah bilang, soal blok terminasi adalah kewenangan dari pemerintah untuk memutuskan.
