Pemerintah Atur Harga Gas Pembangkit

Lalu, ada jaminan pengembang dengan specific fuel consumption (SFC) setara minyak solar (HSD) sebesar 0,25 liter per kWh. Saat ini peraturan baru ini masih dalam proses perundangan. “Sebentar lagi, yang jelas sudah bukan di Kementerian ESDM lagi. Itu (revisi Peraturan Pemerintah (PP) 79/2020) sangat kami tunggu,” kata dia. 

Wakil Badan Kebijakan Fiskal Kementerian Keuangan Goro Ekanto menambahkan, revisi PP cost recovery ini sudah di Sekretariat Negara. Selanjutnya, bakal ada diskusi antara Kementerian Koordinator Perekonomian, Kementerian ESDM, dan Sekretariat Negara. “Artinya tidak lama lagi,” ujarnya. Wiratmaja membeberkan beberapa poin revisi PP 79/2010. Beleid baru itu bakal memberikan kepastian soal perpajakan dalam bisnis migas. Beleid itu juga akan memperjelas fasilitas insentif non fiskal yang dapat diperoleh perusahaan migas, diantaranya investment credit, percepatan depresiasi, dan DMO (domestic market obligation/ kewajiban pasok dalam negeri). 

Sementara untuk insentif fiskal tersebut pernah disebutkan sebelumnya yakni, pada masa eksplorasi dan eksploitasi, pajak pertambahan nilai (PPN) impor, bea masuk, PPN dalam negeri, dan pajak bumi dan bangunan (PBB) akan ditanggung oleh Negara. Selain itu, kontraktor migas juga akan memperoleh pembebasan pajak penghasilan (PPh) pemotongan atas pembebanan biaya operasi fasilitas bersama dalam rangka pemanfaatan barang milik negara dan alokasi biaya overhead kantor pusat. Wiratmaja menyebut, PP 79/2010 tidak memberikan kepastian ini. “Kemudian POD Basis diubah menjadi Block Basis,” katanya. Dalam beleid lama, juga tidak ada kejelasan terkait Block Basis ini.

Selanjutnya, revisi PP 79/2010 ini disebutnya juga menerapkan konsep bagi hasil sliding scale. Dengan skema ini, pemerintah bisa memperoleh bagi hasil lebih besar apabila terdapat windfall profit. Terakhir, revisi itu juga memuat standar dan norma pemeriksaan yang sama dengan pedoman pemeriksaan yang digunakan oleh Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas) dan Ditjen Pajak. Dalam peraturan lama, konsep bagi hasil menganut prinsip fixed scale, sehingga negara tidak mendapat tambahan bagi hasil ketika terdapat windfall profit. 

Sementara soal pemeriksaan, audit-nya dilakukan berlapis oleh beberapa institusi, yakni SKK Migas, Badan Pemeriksa Keuangan (BPK), Badan Pengawasan Keuangan Pembangunan (BPKP), serta Ditjen Pajak. Namun, Goro menambahkan, prinsip Assume and Discharge yang diminta oleh perusahaan migas tidak bisa diberikan dalam revisi PP cost recovery itu. Pasalnya, Undang-Undang tidak membolehkan pemberlakuan prinsip ini. Meski demikian, pemerintah fasilitas yang setara dengan prinsip tersebut. “Secara teknis kami setuju fasilitasnya harusnya meringankan.

Sebelumnya, Pemerintah sepakat merevisi PP 79/2010 guna menarik investasi. Dalam revisi itu, pemerintah akan memberikan insentif fiskal dan non-fiskal yang menaikkan keekonomian proyek, serta menerapkan konsep sharing the pain and the gain. PP 79/ 2010 perlu direvisi lantaran menjadi penghambatan investasi migas nasional. Jika tidak dicarikan solusi, beleid ini bakal membuat kegiatan hulu migas terus berkurang yang tercermin dari terus menurunnya produksi minyak dari 800 ribu barel per hari (bph) pada tahun ini dan diprediksi menjadi 400 ribu bph pada 2020. Pemerintah telah merinci sejumlah permasalahan terkait PP 79/2010. Pertama, pemberlakuan PP 79/ 2010 menghapus rezim assume and discharge dimana pemerintah akan mengganti seluruh pajak tidak langsung yang dibayar kontraktor melalui re-imbusement. Perubahan ini dinilai memperbesar risiko yang harus ditanggung investor. Pasalnya, kontraktor migas harus menanggung pajak bahkan sejak masa eksplorasi yang jika gagal, maka menjadi beban permanen investor. Penghapusan assume and discharge juga membuat keekonomian proyek semakin menurun, utamanya di proyek laut dalam yang butuh biaya besar

Sementara Pertamina telah berinvestasi akan melakukan pengeboran sebanyak 19 sumur. Dia melanjutkan, Pertamina memberi peluang jika Total berkeinginan ikut serta berpartisipasi mengembangkan Blok Mahakam. Menurut dia, Pertamina membuka pintu kepada Total untuk membicarakan keikutsertaan sampai akhir tahun ini.

Beberapa poin penting dalam revisi beleid tersebut yakni terdapat tambahan pasal yang mengatur fasilitas perpajakan bagi kegiatan eksplorasi dan eksploitasi. Dalam bab tambahan disebutkan bahwa kontraktor bisa mendapatkan fasilitas perpajakan. Pada kegiatan eksplorasi, kontraktor bisa mendapatkan fasilitas berupa pembebasan pungutan bea masuk atas impor barang, PPN, dan PPnBM atas perolehan barang atau jasa kena pajak tertentu. Selain itu, pembebasan pajak impor barang kena pajak tertentu, pemanfaatan barang kena pajak tak berwujud dari luar daerah pabean, dan pemanfaatan jasa kena pajak tertentu dari luar daerah pabean. 

Pada masa eksplorasi, kontraktor tidak dipungut pajak penghasilan (PPh 22) atas impor barang dan pengurangan Pajak Bumi dan Bangunan (PBB) 100% terutang yang tercantum dalam Surat Pemberitahuan Pajak Terutang (SPPT). Pada tahap eksploitasi, kontraktor juga mendapat fasilitas berupa pembebasan pungutan bea masuk atas impor barang yang digunakan dalam rangka operasi perminyakan dan atau PPN dan PPnBM yang terutang atas perolehan barang atau jasa kena pajak tertentu dan impor barang kena pajak tertentu. 

Kontraktor juga mendapat fasilitas atas pemanfaatan barang kena pajak tidak berwujud tertentu dari luar daerah pabean di dalam daerah pabean dan atau pemanfaatan jasa kena pajak tertentu dari luar daerah pabean di dalam daerah pabean yang digunakan dalam rangka operasi perminyakan.

Menurutnya, fasilitas perpajakan hanya akan diberikan kepada lapangan tertentu yang memiliki skala keekonomian rendah. Terkait adanya perubahan jenis kontrak kerja sama (production sharing contract/ PSC) dari cost recovery menjadi gross split, disebutnya tidak menjadi hambatan. Lantaran sudah diputuskan dari jauh-jauh hari bahwa kontrak diubah menjadi gross split, maka pihaknya dan kontraktor dapat memperhatikan adanya potensi biaya investasi yang tidak dapat disusutkan (unrecovered cost) dari sekarang. Bisa saja, lanjutnya, unrecovered cost ini menjadi perhitungan dalam penentuan bagi hasil (split) di kontrak berikutnya. “Makanya sekarang lagi dihitung gross split-nya, supaya Pertamina lebih cepat masuk ke dalam (blok terminasi) ,” jelas Taslim.

Taslim menambahkan, pihaknya akan mempersiapkan peralihan operatorship untuk delapan blok migas yang ditugaskan ke Pertamina dengan lebih baik lagi. Selain pemboran lebih awal, perizinan yang diperlukan dalam kegiatan operasi juga akan disiapkan lebih awal. Kemudian, pihaknya juga akan segera menyiapkan kontrak PSC yang baru dari sekarang, tidak mendadak seperti yang terjadi di Blok ONWJ.

Direktur Hulu Pertamina Syamsu Alam menuturkan, masalah transisi kepemilikan blok migas terminasi menjadi fokus perusahaan untuk segera diselesaikan. Pasalnya, kontrak kedelapan blok migas ini bakal berakhir pada tahun depan. Adanya perubahan kontrak dari PSC cost recovery menjadi gross split, diakuinya menjadikan proses transisi lebih rumit. “Usulan kami, kalau menggunakan gross split, kami harus evaluasi dulu. Seperti di Blok ONWJ, kami juga masih harus membahas apakah work plan and budget-nya masih sama dengan sebelum adanya gross split. Karena di satu sisi, kami harus bertanggung jawab ke pemegang saham kegiatan kami cukup ekonomis atau tidak,” kata dia.

Menurutnya, Pertamina telah memiliki sejumlah opsi untuk transisi operatorship sehingga produksi kedelapan blok migas ini tidak terjun bebas. Namun, pihaknya membutuhkan payung hukum agar bisa masuk ke blok terminasi, Seperti layaknya di Blok Mahakam. “Kami berharap secepatnya, kalau bicara bawah permukaan itu kan tidak gampang,” tambahnya. Taslim melanjutkan, pembahasan soal peralihan blok habis kontrak ini telah dimulai di SKK Migas. Payung hukum masa transisi nantinya dapat berupa perjanjian yang dibuat oleh SKK Migas, operator eksisting, dan operator yang melanjutkan operasi di blok tersebut. “Sekarang sudah dibahas di rapat pimpinan (SKK Migas). Nanti akan lebih detail lagi klausul-klausul yang dibahas, lebih intens,” jelasnya.

Tahan Produksi

Dengan langkah-langkah ini, Taslim berharap tidak akan ada penurunan produksi di delapan blok habis kontrak tersebut. Pasalnya, dari saat ini pun, pihaknya terus bekerja sama dengan kontraktor eksisting dan Pertamina supaya menjaga produksi migasnya, setidaknya sama dengan tahun sebelumnya. Alam menambahkan, produksi migas tidak dapat dipastikan langsung turun menjelang kontrak selesai.

Meskipun risiko terburuk penurunan produksi migas itu memang dapat terjadi. Penurunan produksi migas baru terjadi jika kontraktor eksisting tidak melakukan kegiatan investasi. Caranya, jelas dia, Pertamina sedini mungkin akan menyiapkan program-program yang menunjukkan hasil dengan cepat (quick result). Salah satunya yakni dengan menambah sumur yang dibor, memperbanyak kegiatan kerja ulang (work over) sumur, atau lainnya. Kuncinya ada pada transisi.
