Supreme Court Strengthens COSL & Husky Parties

Efforts by the Business Competition Supervisory Commission (KPPU) to defend the decision on the jackpot plot of services drilling rig services between PT COSL Indo and Husky CNOOC Madura Limited ended defeated in the Supreme Court (MA).

The Supreme Court in the verdict of cassation actually reinforced the decision of South Jakarta District Court which overturned the KPPU's decision. In the decision No. 952 K / Pdt. Sus-KPPU / 201 7 Supreme Court declared the petition filed by KPPU.

"Rejected the appeal from the appellant of the Supervisory Commission of the Business Competition Supervisory Commission," the ruling from the Court's Supreme Court Registry official website said Tuesday (2/1).

The cassation is examined by a panel of judges comprising Takdir Rahmadi, Nurul Elmiyah and I Gusti Agung Surnanatha. The verdict was read on October 19, 2017. The verdict as well as reinforce the decision of South Jakarta Commercial Court. 907 K / Pdt.GKPPU / 2016 / PN.Jkt.Sel. which was set by the judge on April 27, 2017. The judges did not find the affiliation facts as mentioned by KPPU which caused a conspiracy.

Chairman of the Supreme Court Justice Takdir Rahmadi said the appellant of the appeal was unable to prove the existence of a conspiracy between PT COSL Indo and Husky CNOOC Madura Limited.

The two companies were not legally and convincingly proven to meet the elements of Article 22 of Law no. 5/1999 on Prohibition of Monopolistic Practices and Unfair Business Competition.

This ruling is also reinforced by testimony from witnesses and experts indicating that the bidding process is in compliance with prevailing regulations and current oil and gas industry conditions.

PT COSL Indo and Husky CNOOC Madura Limited have also received approval from the tender result from SKK Migas. In addition, Appreciation Letter has been given by Husky CNOOC Madura Limited as a service user to PT COSL INDO.

Previously, KPPU filed an appeal over the South Jakarta District Court's decision to win the PT COSL Indo and Husky CNOOC Madura Limited related to the tender conspiracy case. KPPU's legal counsel Nunil Fadilah said that although the court granted the objection to the reported parties I and II, it would not be a stunt in proving the existence of a conspiracy.

Meanwhile, PT COSL Indo and Husky-CNOOC Madura Limited lawyers, Teuku Raja Rajuanda from Firmansyah and Co. law firm. said that from the beginning the KPPU's decision was judged.

This is because the Commission Council did not consider the facts presented by the witnesses reported. Tender services jack-up drilling rig services for BD is to support the drilling and completion of operations and Madura BD Structure is located off the coast Madura Strait KKS Madura. The estimated value of the project reached US $ 34.62 million.

On October 14, 2016, KPPU Commission Assembly read the verdict stating Husky CNOOC (Reported I) and PT COSL Indo (Reported II) violated Article 22 of Law no. 5/199. Both reportedly punished to pay a fine of Rp 12.8 billion and Rp 11.6 billion.

MA Kuatkan Kubu COSL & Husky

Upaya Komisi Pengawas Persaingan Usaha (KPPU) untuk mempertahankan putusan tentang persekongkolan tender jasa jack-up drilling rig services antara PT COSL Indo dan Husky CNOOC Madura Limited berakhir kalah di Mahkamah Agung (MA).

Mahkamah Agung dalam putusan kasasi justru menguatkan putusan Pengadilan Negeri Jakarta Selatan yang membatalkan putusan KPPU. Dalam putusan No. 952 K/Pdt.

Estimasi nilai proyek mencapai US$ 34,62 juta.

Pada 14 Oktober 2016 Majelis Komisi KPPU membacakan putusan yang menyatakan Husky CNOOC (terlapor I) dan PT COSL Indo (terlapor II) melanggar Pasal 22 UU No. 5/199. Kedua terlapor dihukum membayar denda Rp 12,8 miliar dan Rp 11,6 miliar.

Beware Increased Energy Subsidy 2018

The burden of energy subsidy becomes the budget burden again. See, due to rising world crude oil prices, the realization of the budget the energy subsidy of 2017 increases enormously.

The Ministry of Finance noted that until the end of 2017 the realization of energy subsidy budget reached Rp 97.6 trillion, equal to 108.7% of energy subsidy in APBNP 2017 amounting to Rp 89.9 trillion.

The increase in energy subsidy budget last year was like an alarm for this year. It is not impossible that the allocation of energy subsidies in 2018 exceeds the limit as well. Understandably, the government guarantees not to raise the price of fuel oil (BBM) subsidy and electricity tariffs, at least until March 2018. On the other hand, crude oil prices continue to rise.

Yesterday, the price of West Texas Intermediate (WTI) crude oil in the global market was at US $ 60.29 per barrel. Goldman Sachs projection, Brent oil price at the level of US $ 62 per barrel at the end of the first quarter of 2018. The number of indications is far above the Indonesian oil price assumption (ICP) in the 2018 APBN of US $ 48 per barrel.

By comparison, as of November 2017, with the average price of WTI oil in the world market at US $ 56.81 barrel, ICP was set at US $ 59.34 per barrel. While the average ICP last year was estimated at US $ 50 per barrel, above the target of US $ 45 per barrel

Finance Minister Sri Mulyani Indrawati is not worried about the upward trend in oil prices. Indeed, the allocation of energy subsidies increases if oil prices rise. On the other hand, rising oil prices also raised state revenues from oil and gas.

Finance Minister Sri Mulyani Indrawati

"ICP above target is not a problem because subsidy cost increase is less than the increase of state revenue," said Sri Mulyani.

He added that the increase in the allocation of energy subsidies in 2017 caused two things. First, changes in world oil price assumptions. Second, last year's underpayment or carry over.

"This is for Pertamina and PLN which are under pressure," explained Sri Mulyani.

Satya Widya Yudha

Vice Chairman of Commission VII of the House of Representatives Satya Widya Yudha suggested that the government should propose a revision of the ICP assumption in the draft APBN-P 2018.

"ICP rises, the subsidy budget also increases, and the government should also be able to maintain the volume of energy subsidy distribution," Satya said.

Waspadai Peningkatan Subsidi Energi 2018

Beban subsidi energi menjadi beban anggaran lagi. Lihat saja, akibat kenaikan harga minyak mentah dunia, realisasi anggaran subsidi energi tahun 2017 bertambah sangat besar.

Sementara rata-rata ICP sepanjang tahun lalu diperkirakan US$ 50 per barel, di atas target US$ 45 per barel

Dia menambahkan, kenaikan alokasi subsidi energi tahun 2017 disebabkan dua hal. Pertama, perubahan asumsi harga minyak dunia. Kedua, pembayaran kurang bayar tahun lalu atau carry over.

Pertamina Manage Mahakam

The Decrease of Oil and Gas Production Strives 30 Percent Per Year

The management of the Mahakam block in East Kalimantan shifted from Total E&P Indonesie to PT Pertamina as of January 1, 2018. The transfer of large-scale oil and gas blocks poses Pertamina's challenge in managing the expired block of contracts. There are 38 oil and gas blocks in the country that will expire until 2026.

The transfer of management rights of the Mahakam block is done shortly before the turn of 2017 to 2018 in Balikpapan, East Kalimantan. The rich gas block is managed by Total E&P Indonesia (TEPI) since 1967 and its contract expired as of December 31, 2017.

the Mahakam block

Mahakam block is returned Total E&P Indonesia to the Republic of Indonesia, in this case the Special Unit for Upstream Oil and Gas Business Activities (SKK Migas), and subsequently submitted to Pertamina.

"The management of this block is full of challenges in the form of complex field conditions and the age of old wells so that productivity drops dramatically. This is a good time for Pertamina to prove that we are capable of managing large blocks, "said Pertamina Upstream Director Syamsu Alam, after receiving the right to manage the Mahakam block from SKK Migas on Monday (1/1) in Balik-
Board.

The peak of Mahakam Block gas production reached 2.8 billion standard cubic feet per day (BSCFD) in 2009. The peak oil production was 230,000 barrels per day in 1977. Currently, the remaining reserves of Mahakam Block gas are 4.9 trillion cubic feet ( TCF) and oil reserves of 57 million barrels.

The daily production of natural gas throughout 2017 recorded 1,286 million standard cubic feet per day (MMSCFD) and oil of 51,700 barrels per day.

"Another challenge is how to maintain operating standards that have been applicable before, while still managed Total E&P Indonesia. If possible, the standard should be improved even better, "said Syamsu.

President Director of PT Pertamina Hulu Indonesia, a subsidiary of Pertamina, which manages Mahakam-Bambang Manumayoso, said the investment is set as much as 1.7 billion US dollars or equivalent to Rp 23 trillion for 2018. The investment has been spent throughout 2017 of 150 million US dollars 2 trillion), one of which is to drill 15 development wells.

"The rate of decline in oil and gas production in the Mahakam block reaches 51 percent per year. We will strive to reduce the rate to about 30 percent by the method of well work and drilling of development wells, "said Bambang.

Associated with the status of TEPI employees who were previously involved in the management of the Mahakam Block, according to Bambang, they are now employees of Pertamina. Total E&P Indonesia Total employee while managing Mahakam Block as many as 1,919 people. After being taken over by Pertamina, the number of employees who joined and remained in the block as many as 1885 people or about 98.23 percent who moved to Pertamina employees.

Not ready

Based on the Regulation of the Minister of Energy and Mineral Resources Number 37 of 2016, oil and gas producing areas get a participation stake of 10 percent. The shares are granted to regional-owned enterprises (BUMD).

However, according to Assistant II for Economic Affairs and Development of East Kalimantan Province Ichwansyah, Regional Owned Enterprises (BUMD) is not fully prepared. Currently there is still talks between the Government of East Kalimantan Province and the Government of Kutai Kartanegara Regency. So far, the region is already willing to take the 10 per cent participation right.

"There are many challenges (in the formation of BUMD) and we need the support of all parties, including the central government, so that this will be realized soon," said Ichwansyah.

Head of SKK Migas Amien Sunaryadi hopes East Kalimantan Provincial Government and Pemerinath of Kutai Kartanegara Regency to settle the issue of the shares of participation. Because, if the settlement is delayed longer, then the longer the area will get profit sharing from the Mahakam Block. However, this problem certainly will not interfere with the operation of the Mahakam Block.

"We are still waiting for the establishment of BUMD shareholders 10 percent later. There is no time limit when to be formed immediately BUMD. It's just that the regions themselves are losers if not immediately formed because it will delay their acceptance, "said Amien.

Involvement

Meanwhile, Total E&P Indonesia has not yet found an agreement to engage in the management of the Mahakam Block. The government has signaled that Total E&P Indonesia can get 39 percent of management. If the share was taken, Pertamina controls 51 percent shares.

"The talks with Pertamina are still ongoing. Our target before the end of January is no decision, "said President and General Manager of Total E&P Indonesia Arividya Noviyanto.

Regarding the transfer of management, said Arividya, it believes Pertamina can maintain the oil and gas production performance of the Mahakam Block. The block known as the largest gas producer since the early 2000s has an important contribution to gas production in Indonesia. Gas from the Mahakam Block contributes 13 percent of Indonesia's total gas production.

The Mahakam Block cooperation contract was signed on 6 October 1966 for a period of 30 years. TEPI as operator with 65 percent share cooperating with Inpex Corporation (Japan) which owns 35 percent shares. In 1991, Total E&P Indonesia obtained a contract extension for 20 years until March 30, 2017 The Mahakam Contract incurred an additional period of nine months until December 31, 2017 due to a renewal of the liquefied natural gas sales contract.

Pertamina Kelola Mahakam

Laju Penurunan Produksi Migas Diupayakan 30 Persen Per Tahun

Belum siap

Berdasarkan Peraturan Menteri ESDM Nomor 37 Tahun 2016, daerah penghasil migas mendapat saham partisipasi sebesar 10 persen.

”Kami tetap menunggu kesiapan dibentuknya BUMD pemegang saham 10 persen nanti.

Previously the management was in the hands of Total E & P Indonesia and lnpex Japan for 50 years.

2. Transition Through Several Stages

Pertamina during the transition period has made various efforts and coordination with all parties. Given the management of the Mahakam Working Area as a state duty to be carried out in accordance with the main tasks, and Pertamina functions as a SOE.

"Management is carried out while maintaining the production of the Mahakam Block Working Area whose peak production reservoir in the 2003-2009 period has been exceeded.

PHM controls operating costs and keeps QHSSE (Quality, Health, Safety, Security and Environment) in operation, "Pertamina Upstream Director Syamsu Alam said.

Previously, Pertamina has successfully proven the management of post-mining oil and gas blocks, Offshore North West Java (ONWJ) Block in 2009, and West Madura Offshore (WMO) in 2011.

3. Mahakam Block Potentially Profitable

Based on SKK Migas data as of November 2017, the Mahakam Working Area produces oil and condensate of 52 thousand barrels of oil per day, and 1.360 million cubic feet of natural gas per day. That's what makes the Mahakam Block has enough potential promising, with evidence as of January 1, 2018 of 4.9 trillion Cubic Feet (TCF) of gas, 57 million barrels of oil, and 45 million barrels of condensate.

Meanwhile, in the Work Program and Budget Agreement (WP & B) 2018, SKK Migas targets PHM production of 42.01 thousand barrels of oil per day, and 916 mmscf of gas per day. Production Target Down

The target of natural gas production from the Mahakam block in 2018 is 916 million cubic feet per day or Down by 32.65% compared to the realization as of November 2017.

The Mahakam Block gas production target refers to the work plan and budget proposed by PT Pertamina as the new operator of offshore oil and gas blocks in East Kalimantan. Based on data from SKK Migas, the daily average gas production of Mahakam Block as of November 2017 reached 1.360 million cubic feet per day / MMscfd and condensate of 52,000 barrels per day (bpd).

The Mahakam Block

The target of condensate production in the Mahakam block this year is only 42,000 bpd, lower than the realization during 2017. The oil and gas production target this year is achieved by drilling 69 development wells, 132 reforestation wells, 5,623 wells and advanced development plan on five oil and gas fields in the Mahakam block. Previously, Pertamina targeted gas production of 1,100 MMScfd and 48,000 bph condensate.

In terms of activities, Pertamina previously planned to drill 55 development wells, 125 wells for re-operation, and maintenance of 5,500 wells.

Head of Program and Communications Division of SKK Migas Wisnu Prabawa Taher said it was considering technical discussions on the side of reservoir capability and economy.

"I do not know the 1,100 [MMscfd]. The details are nearly 1,000 [MMscfd]. Already through technical discussion we also discuss the reservoir and economy, "he said

From Pertamina data, the Mahakam block gas production is estimated to increase to 1,207 MMscfd from the condition should be around 782 MMscfd by 2019. Gas production is also projected to rise in 2020 to 1,268 MMscfd from the condition of 551 MMscfd. Production rates in the range of 1,200 MMScfd will survive until 2022 when the real conditions, without the effort of adding the well drilling, ie 274 MMscfd.

Related to Mahakam oil and gas production plan in 2018, President Director of PT Pertamina Hulu Indonesia, a subsidiary of Pertamina managing the Mahakam block, Bambang Manumayoso did not respond when contacted.

The Mahakam Block cooperation contract operated by Pertamina replaces Total E & P Indonesie on Monday, January 1, 2018. Pertamina has signed a new cooperation contract for the management of the Mahakam block in 2015. The Government has set a time of 2 years to transition the operation of the Mahakam Block previously operated by Total France cooperated with Inpex Japan for 50 years.

KEEP PRODUCTION

Upstream Director of Pertamina Syamsu Alam said that it has made efforts to maintain production of the Mahakam Block which contributes about 30% of national gas production. Until the end of the transition period, the company can complete 14 well drilling.

Although it has passed the peak production period in the period 2003-2009, the ability of the Mahakam Block to emit oil and gas is still maintained. Total oil and gas reserves remaining by 2016 amounted to 57 million barrels of oil and gas 4.9 trillion cubic feet.

However, from Working Meeting material with Commission VII in January 2016 using data from January 1, 2015, the proven reserve status for oil is 91, 37 million barrels of oil and gas 2.4 trillion cubic feet. Syamsu said, the company is optimistic to achieve oil and gas production target with a budget of US $ 1.7 billion and adjustment of 530 current contracts with third parties. Another thing that is also important is the transition of 98.23% of the workforce previously uniformed Total also runs smoothly.

Total & Inpex Still Discusses Price 39% Mahakam Block

Inpex Corporation and Total EP hope to still be able to partner with PT Pertamina in managing the Mahakam Block in Kalimantan. Understandably, from January 1, 2018, the management of the Mahakam block shifted from Total EP to PT Pertamina Hulu Mahakam, a subsidiary of PT Pertamina Hulu Indonesia.

the Mahakam Block

Senior Specialist of Media Relations Moch N. Kurniawan said that Inpex is cooperating with Total EP Indonesie to process businees to business (B to B) with Pertamina related to the share purchase plan in Mahakam block.

"Currently, Inpex continues to discuss with the Government of Indonesia and Pertamina, in cooperation with Total EP, participate in the new Mahakam Block's PSC (profit-sharing contract) after 2017," explained Kurniawan

But Iwan has not been willing to disclose the details of the purchase of shares in the Mahakam Block further. Previously the government has approved Total EP and Inpex can get 39% stake in Mahakam block.

"The details we cannot explain because the talks with the Government of Indonesia and Pertamina are still ongoing," explained lwan.

However, if you want to buy shares in the Mahakam block, Inpex and Total EP must prepare a jumbo fund. Based on data from the Special Unit for Upstream Oil and Gas Business Activities (SKK Migas), the estimated value of Mahakam assets as of December 31, 2017 (capital assets, inventory and inventory materials) amounted to US $ 9.43 billion.

If in the form of rupiah using the exchange rate of Rp 13,000 per US dollar around Rp 122.59 trillion. This figure is significantly increased from the initial calculation of oil and gas SKK at the beginning of the year which only estimates the asset valuation of the Mahakam Block by the end of 2017 for only US $ 3.45 billion.

The increase is due to rising world oil prices and the existence of physical checks that are internal SKK Migas. Not to mention the production potential of Mahakam Block is still brilliant.

SKK Migas noted that the Mahakam Block produces oil and condensate of 52,000 barrels of oil per day and 1.360 million cubic feet of natural gas per day. Proven reserves as of January 1, 2016 are 4.9 trillion cubic feet (TCF) of gas, 57 million barrels of oil and 45 million barrels of condensate.

If the current asset value of the Mahakam Block is US $ 9.43 billion, Total EP and Inpex must pay US $ 3.67 billion or equivalent to Rp 49 trillion. Unfortunately, Iwan and President & General Manager of Total E & P Indonesie (TEPI), Arividya Noviyanto did not answer the confirmation of the ability to pay Rp 49 trillion.

Syamsu Alam Director Hulu Pertamina said that besides Total EP and Inpex, there are some companies that have expressed interest to enter Mahakam.

"The process is preferred B to B and certainly not just the percentage," he said.

Total & Inpex Masih Membahas Harga 39% Blok Mahakam

Belum lagi potensi produksi Blok Mahakam masih cemerlang.

"Prosesnya diutamakan B to B dan tentu bukan hanya besaran persentase," kata dia.

PT Pertamina EP started the year 2018 by increasing production achievement. The trick, do the tap (early activity make well hole) MJ-AA5 in Village Mangunjaya, District Babat Toman, Regency of Musi Banyuasin, South Sumatra (Sumsel).

Pertamina EP President Director Nanang Abdul Manaf said, MJ-AA5 is a well drilling exploitation with a depth of 500 meters. Drilling activities are projected to take approximately 16 days and drilling targets this time in the form of oil.

The well is the first well drilled after the closure of illegally seized wells or illegal drilling in the area of Mangunjaya Village.

"This confirms that Pertamina EP is determined to produce oil and gas legally and to comply with the prevailing government regulations and best practice rules of oil and gas," Nanang said.

The MJ-AA5 well drilling is conducted by PT Pertamina Drilling Services Indonesia, a subsidiary of PT Pertamina using Pertamina Drilling Services N55 rig. The location of the Well MJ-AA5 is adjacent to the MJ 67 Well that was taken over by illegal miners and is now closed.

Nanang explained, the achievement of oil and gas production targets directly impact the state revenue. Thus, Pertamina EP is optimistic to face the year 2018 with the spirit of honest, sincere, and trust.

"We continue to work on improving production by taking into account environmental and social aspects," Nanang said.
