Pertamina Still Has Opportunity



Although the government will prioritize existing contractors to extend the termination of oil and gas blocks, PT Pertamina (Persero) still has a chance to take over the working area. Pertamina may propose the termination of oil and gas blocks. If Pertamina's offer is more attractive than the existing contractor, the government can grant the right to manage the termination working area of ​​oil and gas to the company.

Pertamina Masih Punya Peluang

Jika penawaran Pertamina lebih menarik dibandingkan dengan kontraktor eksis, pemerintah bisa memberikan hak kelola Wilayah kerja migas terminasi kepada perseroan.

Melalui Peraturan Menteri ESDM No. 23/2018 tentang Pengelolaan Wilayah Kerja Migas yang Berakhir Kontrak Kerja Samanya, kontraktor eksis akan di prioritaskan untuk memperpanjang kontrak di blok migas terminasi. Kepala Biro Komunikasi, Layanan Informasi Publik, dan Kerja Sama Kementerian ESDM Agung Pribadi mengatakan, program kerja untuk kelanjutan pengelolaan wilayah kerja migas terminasi harus dijaga kualitasnya. Kualitas pengelolaan yang harus dijaga itu meliputi kemampuan teknis, finansial, dan harus tetap memberikan hasil yang lebih besar bagi negara.

“Kalau hasil wilayah kerja migas itu lebih besar, penerimaan negara akan bertambah lebih banyak dan bisa dimanfaatkan oleh negara untuk kebutuhan yang lebih luas lagi,” ujarnya, Selasa (8/5).

Agung pun menampik kalau kebijakan yang ada dalam Peraturan Menteri ESDM No. 23/2018 itu tidak membuat Pertamina, selaku perusahaan migas nasional, tidak diberikan kesempatan mengelola wilayah kerja terminasi tersebut.

“Mereka [Pertamina] bisa mengajukan permohonan pengelolaan blok terminasi seperti kontraktor lain, nanti akan dievaluasi permohonannya oleh tim SDM dan lintas instansi lainnya,” ujarnya.

Plt. Direktur Utama Pertamina Nicke Widyawati pun merespons positif kebijakan Peraturan Menteri ESDM No. 23/2018 tersebut. Kebijakan itu disebut bisa mendorong profesionalisme dan daya saing perseroan.

“Hal itu bisa membuat Pertamina memiliki fondasi yang lebih kuat untuk tumbuh makin besar. Kami juga masih memiliki kesempatan untuk mendapatkan blok terminasi, intinya kami juga memiliki tugas untuk memberikan manfaat yang lebih besar bagi negara,” ujarnya.

Pada Pasal 13, Peraturan Menteri ESDM No. 23/2018 pun tertulis Menteri ESDM yang akan menetapkan pengelolaan blok terminasi tersebut. Agung menuturkan, penetapan pengelolaan itu memiliki acuan, yakni proposal pengajuan yang bisa memberikan manfaat lebih besar bagi negara. 

“Ini kan sesuai dengan amanat konstitusi dan prioritas pemerintah,” tuturnya.

Sebelumnya, pemerintah telah memberikan 10 blok migas kepada Pertamina dalam beberapa tahun terakhir. Blok migas itu terdiri atas Offshore North West Java (ONWJ), Mahakam, Tengah, Attaka, East Kalimantan, North Sumatra Offshore, Sanga-sanga, Southeast Sumatra, Tuban, dan Ogan Komering. Sebelumnya, Indonesia Resources Studies (IRESS) meminta Peraturan Menteri ESDM No. 23/2018 itu dicabut. Aturan itu dinilai bisa membuat pengelolaan blok migas terminasi berlanjut ke tangan perusahaan asing.

Direktur Eksekutif IRESS Marwan Batubara menyebutkan, Peraturan Menteri ESDM No. 23/2018 itu juga ada potensi terjadinya kasus bagi-bagi saham kepada perusahaan siluman secara gratis atau membayar dengan nilai jauh dari harga seharusnya.

Petronas Show Positive Performance



Getting to Know the Oil and Gas Field of Bukit Tua Working Area Ketapang Field Oil and Gas (Migas), Bukit Tua Working Area (WK) Ketapang North Coast Madura Island, East Java. Being a proof of the commitment of Petronas (Petroliam Nasional Berhad), Malaysian oil and gas company invests in upstream oil and gas sector in Indonesia. There are at least five structures or wells have been drilled in this WK namely Bukit Tua Selatan, Jenggolo, Bukit Panjang, Payang and Terani. To channel gas production, Petronas builds a 110km-long seabed pipe from Onshore Receiving Facilities (ORF) facility. 

     With capacity of 70 Million Standard Cubic Feet Per Day (MMSFD), located in Maspion Industrial Estate (KIM), Kee Manyar, Gresik, In addition, Petronas also uses Floating Production Storage And Offloading (FPSO) units that are floating units used to take oil in the ocean, as well as processing it into finished oil and directly flowed to Pertamina.

Performance of Petronas in WK Ketapang also promising since May 2015 succeeded in flowing oil. The inauguration of the first production of an ORF facility developed was conducted on November 4, 2015. The resulting production is fairly good at around 17 thousand barrels per day (BPH).

According to Andiono, gas produced from Bukit Tua field will be channeled to PT Perusahaan Listrik Negara (PLN) to support electricity supply in East Java through Petrogas Jatim Utama (PJU), PJU is a Regional Government Owned Enterprise (BUMD) of East Java Provincial Government. 

    As a Cooperation Contract Contractor (KKS Contractor), Petronas is also complied with the Corporate Social Responsibility (CSR) rules. Petronas cooperates with Trunojoyo Madura University (UTM) to identify the social map of communities in three districts in East Java where Petronas operates in WK Ketapang, Gresik regency, Bangkalan regency and Sampang regency.

The targeted TJS program reached 13 sub-districts with 29 villages, and obtained data that many unskilled unemployed, stops schooling, lack of access to health, no access to clean water, flooding during the rainy season, and minimal fisherman support.

Petronas Tunjukan Kinerja Positif


Mengenal Lapangan Migas Bukit Tua Wilayah Kerja Ketapang Lapangan Minyak dan Gas (Migas), Bukit Tua Wilayah Kerja (WK) Ketapang Pantai Utara Pulau Madura, Jatim. Menjadi bukti komitmen Petronas (Petroliam Nasional Berhad), perusahaan Migas Malaysia berinvestasi di sektor hulu Migas di Indonesia. 

     WK Ketapang resmi ditandatangani sebagai kontrak PSC (Production Sharing Contract), dengan Pemerintah Republik Indonesia melalui Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi (SKK Migas), pada 11 Juni 1998.

Sejak menguasai WK Ketapang, setelah mengambil alih saham Conoco Phillips, pada 1 Desember 2000 hingga 25 Juli 2008, kegiatan operasi PETRONAS menunjukkan kinerja yang sangat positif. Setidaknya ada lima struktur atau sumur telah dibor di WK ini yaitu Bukit Tua Selatan, Jenggolo, Bukit Panjang, Payang dan Terani. Untuk mengalirkan produksi gas, Petronas membangun pipa dasar laut sepanjang 110 km dari fasilitas penerimaan darat atau Onshore Receiving Facilities (ORF). 

    Dengan kapasitas 70 Million Standard Cubic Feet Per Day (MMSFD), yang terletak di Kawasan Industri Maspion (KIM), Kee Manyar, Gresik, Selain itu, Petronas juga menggunakan unit FPSO (Floating Production Storage And Offloading) yaitu unit terapung yang digunakan untuk mengambil minyak di lautan, sekaligus memprosesnya menjadi minyak jadi dan langsung dialirkan ke Pertamina.

Kinerja Petronas di WK Ketapang juga menjanjikan sejak Mei 2015 berhasil mengalirkan minyak bumi. Peresmian produksi pertama dari fasilitas ORF yang dikembangkan telah dilakukan pada 4 November 2015. Produksi yang dihasilkan terbilang bagus yakni sekitar 17 ribu barel per hari (BPH).

“Sehingga kini, Petronas berharap produksi minyak dapat digenjot hingga hasil optimum 20 ribu BPH sedangkan produksi gas sekitar 37 MMSFD atau 46 MMBTU,” kata Senior Manager Corporate Affairs and Administration PC Muriali, Andiono Setiawan.

Menurut Andiono, gas yang diproduksikan dari Lapangan Bukit Tua akan dialirkan ke PT Perusahaan Listrik Negara (PLN) untuk mendukung penyediaan listrik di Wilayah Jatim melalui Petrogas Jatim Utama (PJU), PJU adalah Badan Usaha Milik Daerah (BUMD) Pemerintah Provinsi Jatim. Sebagai Kontraktor Kontrak Kerja Sama (Kontraktor KKS), Petronas juga comply dengan aturan Tanggung Jawab Sosial (TJS/CSR) perusahaan. 

    Petronas menggandeng Universitas Trunojoyo Madura (UTM), untuk mengidentifikasi peta sosial komunitas di tiga kabupaten di Jawa Timur yang menjadi tempat beroperasinya Petronas di WK Ketapang yaitu Kabupaten Gresik, Kabupaten Bangkalan dan Kabupaten Sampang.

Program TJS yang disasar mencapai 13 kecamatan dengan 29 desa, dan diperoleh data bahwa banyak pengangguran yang tidak memiliki keterampilan, berhenti sekolah, akses kesehatan yang minim, tidak ada akses air bersih, banjir saat musim hujan, dan dukungan nelayan yang minim.

Currently, Pendopo and Raja is managed by Joint Operating Body (JOB) of Pertamina Golden Spike Energy Indonesia, where PT Golden Spike and PT Pertamina Hulu Energi Raja Tempirai hold 50% participation rights. Furthermore, Bula Block is currently managed by Kalrez Petroleum (Seram) Ltd with 100% ownership interest.



Next, the Seram Non Bula Block is operated by CITIC Seram Energy Limit with ownership interest of 51% with KUFPEC partners 30%, Gulf Petroleum 16.5% and Lion Energy 2.5%. Finally, Jambi Merang Block is operated by JOB Pertamina-Talisman Jambi Merang where Pertamina holds 50% participation rights, Talisman 25%, and Pacific Oil and Gas Indonesia 25%.


Previously, the government issued Regulation of the Minister of Energy and Mineral Resources No. 23 of 2018 on the management of oil and gas working area that ended his contract. In this regulation, the sequence of terminating oil and gas blocks management is the extension of PSC by the contractor, the management by Pertamina, then the joint management between the contractor and Pertamina.


Arcandra once revealed that Ministerial Regulation 23/2018 is intended to keep the oil and gas production from terminated oil and gas blocks not down ahead of the end of the contract. This Ministerial Regulation is expected to provide investment certainty for oil and gas companies. The contract form for the new contract will still use the gross split scheme. 

       Referring to data from the Ministry of Energy and Mineral Resources, there are 21 oil and gas blocks that will expire in 2019-2026, including four oil and gas blocks that expired in 2019 earlier. In 2020, Block J Block South Bl, Brantas, Salawati Bird's Head, Malacca Strait, Makassar Strait, and Onshore Salawati Basin will be completed by contract.

In 2021, the contracted block is the Bentu Segat Block, the Long Strait, and the Rokan Block which produces the largest oil in Indonesia. In 2022, following the Tarakan East Block, Coastal Plains and Pekanbaru, Bengkal, and Sengkang will be completed by contract. Furthermore in 2023, Rimau Block, Jabung, and Corridor. The Corridor Block is one of the blocks with a large gas production in Indonesia which is worked on by Conoco Philips. In 2025, the Bangko Block will follow the completion of the contract.

Pemerintah Segera Tetapkan Pengelola Empat Blok Terminasi


Pemerintah akan menetapkan pengelola baru untuk empat blok migas yang akan berakhir kontraknya tahun depan, pada pekan ini. Kontraktor eksiting berpeluang tetap menjadi pengelola empat blok ini.

“Bahas WK (Wilayah kerja) terminasi dulu, ini harus cepat. Minggu ini tanda tangan,” kata Wakil Menteri Energi dan Sumber Daya Mineral (ESDM) ArcandraTahar di Jakarta.

Direktur Pembinaan Usaha Hulu Minyak dan Gas Bumi Kementerian. ESDM Ediar Usman menjelaskan, penandatanganan yang dimaksud yakni surat keputusan terkait penetapan pengelolaan serta prasyarat (terms and condition) kontrak untuk empat blok migas yang akan selesai kontraknya pada tahun depan. Keempat blok migas ini adalah Blok Pendopo dan Raja, Bula, Seram Non Bula, dan Jambi Merang.

Pemerintah menetapkan kontraktor eksisting untuk menggarap empat blok migas ini. Namun, sebelum Kamis (10/5), kontraktor eksisting harus mengajukan permohonan kelanjutan pengelolaan blok yang kini di kerjakan. Hal ini bukan berarti penetapan ini bukan keputusan akhir yang langsung diikuti dengan penandatanganan kontrak kerja sama (production sharing contract/ PSC).

“Belum (tanda tangan kontrak). Nanti SKK Migas panggil (kontraktor eksisting) , sanggup tidak (memenuhi terms and condition). Kalau tidak sanggup, biarkan saja,” jelas dia. Terms and condition yang dimaksud diantaranya adalah besaran bonus tanda tangan, komitmen investasi tiga tahun pertama, besara hak partisipasi, dan lainnya. Rincian terms and condition tersebut merupakan wewenang Menteri ESDM. Rencananya surat keputusan ini terbit pada Jumat (11/5)

“Jadi tanggal 11 Mei ditetapkan Menteri ESDM. Dibilang begitu oleh Pak Wamen tadi,” kata Ediar.

Saat ini, Blok Pendopo dan Raja dikelola oleh Joint Operating Body (JOB) Pertamina Golden Spike Energy Indonesia, di mana PT Golden Spike dan PT Pertamina Hulu Energi Raja Tempirai memegang hak partisipasi 50%. Selanjutnya, Blok Bula saat ini masih dikelola Kalrez Petroleum (Seram) Ltd dengan kepemilikan saham partisipasi 100%.

Berikutnya, Blok Seram Non Bula dioperatori CITIC Seram Energy Limit dengan kepemilikan hak partisipasi 51% bersama mitra KUFPEC 30%, Gulf Petroleum 16,5%, dan Lion Energy 2,5%. Terakhir, Blok Jambi Merang dioperatori oleh JOB Pertamina-Talisman Jambi Merang di mana Pertamina memegang hak partisipasi 50%, Talisman 25%, dan Pacific Oil and Gas Indonesia 25%.

Sebelumnya, pemerintah menerbitkan Peraturan Menteri ESDM No 23 Tahun 2018 tentang pengelolaan Wilayah kerja migas yang berakhir kontraknya. Dalam regulasi ini, urutan pengelolaan blok migas terminasi yakni perpanjangan PSC oleh kontraktor, pengelolaan oleh Pertamina, kemudian pengelolaan bersama antara kontraktor dan Pertamina.

Arcandra pernah mengungkapkan, Peraturan Menteri 23/2018 dimaksudkan untuk menjaga agar produksi migas dari blok migas terminasi tidak turun jelang kontrak berakhir. Peraturan Menteri ini diharapkan memberikan kepastian investasi bagi perusahaan migas. Bentuk kontrak untuk kontrak baru nantinya tetap menggunakan skema bagi hasil kotor (gross split). 

     Mengacu pada data Kementerian ESDM, terdapat 21 blok migas yang akan berakhir pada 2019-2026, termasuk empat blok migas yang habis pada 2019 tadi. Pada 2020, Blok South Jambi Block B, Brantas, Salawati Kepala Burung, Malacca Strait, Makassar Strait, serta Onshore Salawati Basin akan rampung kontraknya.

Pada 2021, blok yang terminasi kontraknya adalah Blok Bentu Segat, Selat Panjang, dan Blok Rokan yang menghasilkan minyak terbesar di Indonesia. Pada 2022, menyusul Blok Tarakan East, Coastal Plains and Pekanbaru, Bengkal, serta Sengkang bakal rampung kontraknya. 

   Selanjutnya di 2023, Blok Rimau, Jabung, dan Koridor. Blok Koridor merupakan salah satu blok dengan produksi gas cukup besar di Indonesia yang digarap Conoco Philips. Di 2025, Blok Bangko akan menyusul rampung kontraknya.

Next Week Three Oil and Gas Contracts will be signed



Three oil and gas production sharing contrac (PSC) contracts for 2017 auction results are scheduled to be signed next week. The total investment commitment for the first three years of the three oil and gas blocks reaches US $ 13.87 million.

The three oil and gas contracts are the Merak-Lampung Block with PT Tansri Madjid Energi, and the Pekawai Block and West Yamdena with PT Saka Energi Indonesia. In last year's auction of oil and gas blocks, five oil and gas blocks were won by oil and gas companies. However, in early April, two new contracts were signed for the Andaman II Block with the Consortium of Premiere Oil Far East Ltd, Kris Energy (Andaman II) BIC and Mubadala Petroleum (Andaman II JSA) Ltd, and the Andaman I Block with Mubadala Petroleum (SE Asia) Ltd. Ediar explained, PSC for the other three new blocks signed in the next week because there is still a guarantee of investment commitments the first three years of unfinished.

The total investment commitment for the first three years for the three oil and gas blocks is US $ 13.87 million. In detail, investment commitment in Merak-Lampung Block is US $ 1.32 million, Pekawai Block is US $ 10.45 million and West Yamdena Block is US $ 2.1 million. In addition, the government will also get a signature bonus with a total of US $ 1.5 million.

Furthermore, in June, the government plans to sign four oil and gas block contracts offered at an auction of direct oil and gas blocks of 2018. These four PSCs are for Citarum Block with PT Cogen Nusantara Energi and PT Green World Nusantara, East Ganal Block with Eni Indonesia Ltd, Block East Seram Lion Energy Ltd, and Southeast Jambi Block with Talisman West Bengara BV-MOECO-South Sumatra Co Ltd Consortium.



The total investment commitment for the first three years for the four blocks is US $ 44.65 million. In detail, investment commitment in Citarum Block is US $ 3.75 million, East Ganal Block US $ 35.35 million, East Seram Block US $ 900 thousand, and Southeast Jambi Block US $ 4.65 million. While the total signature bonus is US $ 3.25 million.

He added that all signed contracts are required to use Gross Splits Production Sharing Contract (PAS) scheme according to the prevailing regulations. Pekan Depan, Tiga Kontrak Migas akan di tanda tangani


Sebanyak tiga kontrak kerja sama (production sharing contrac/PSC) blok migas hasil lelang 2017 dijadwalkan untuk ditandatangani pada pekan depan. Total komitmen investasi tiga tahun pertama ketiga blok migas ini mencapai US$ 13,87 juta.

Tiga kontrak migas tersebut yakni Blok Merak-Lampung dengan PT Tansri Madjid Energi, serta Blok Pekawai dan West Yamdena dengan PT Saka Energi Indonesia. “Itu tanggal 14 Mei (kontraknya) akan ditandatangani,” kata Direktur Pembinaan Usaha Hulu Migas Kementerian Energi dan Sumber Daya Mineral (ESDM) Ediar Usman di Jakarta.

Dalam lelang blok migas tahun lalu, terdapat lima blok migas yang dimenangi oleh perusahaan migas. Namun, pada awal April lalu, baru dua kontrak yang ditanda tangani yakni untuk Blok Andaman II dengan Konsorsium Premiere Oil Far East Ltd, Kris Energy (Andaman II) BIC dan Mubadala Petroleum (Andaman II JSA) Ltd, serta Blok Andaman I dengan Mubadala Petroleum (SE Asia) Ltd. Ediar menjelaskan, PSC untuk tiga blok lainnya baru ditanda tangani pada pekan depan lantaran masih adanya jaminan komitmen investasi tiga tahun pertama yang belum selesai.

“Kemudian masih ada yang salah juga pada detail kontrak ,” tutur dia.

Total komitmen investasi tiga tahun pertama untuk ketiga blok migas ini yakni sebesar US$ 13,87 juta. Rincinya, komitmen investasi di Blok Merak-Lampung US$ 1,32 juta, Blok Pekawai US$ 10,45 juta, dan Blok West Yamdena US$ 2,1 juta. Selain itu, pemerintah juga akan memperoleh bonus tanda tangan dengan total US$ 1,5 juta. 

Selanjutnya, pada Juni, pemerintah berencana akan menandatangani empat kontrak blok migas yang ditawarkan pada lelang blok migas penawaran langsung 2018. Empat PSC ini yakni untuk Blok Citarum dengan PT Cogen Nusantara Energi dan PT Green World Nusantara, Blok East Ganal dengan Eni Indonesia Ltd, Blok East Seram Lion Energy Ltd, serta Blok Southeast Jambi dengan Konsorsium Talisman West Bengara BV-MOECO-South Sumatra Co Ltd.

Total komitmen investasi tiga tahun pertama untuk empat blok ini yakni US$ 44,65 juta. Rincinya, komitmen investasi di Blok Citarum US$ 3,75 juta, Blok East Ganal US$ 35,35 juta, Blok East Seram US$ 900 ribu, dan Blok Southeast Jambi US$ 4,65 juta. Sementara total bonus tanda tangan yakni US$ 3,25juta.

“Awal Juni (kontrak ditandatangani),” tutur Ediar. 

Ditambahkannya, seluruh kontrak yang ditanda tangani wajib menggunakan skema Produstion Sharing Contract (PAS) bagi hasil kotor (gross split) sesuai peraturan yang berlaku. Pemerintah melelang lima blok migas melalui penawaran langsung ini. Namun, satu blok tidak ada pemenangnya, yakni Blok East Papua. Ediar menjelaskan, hal ini lantaran perusahaan yang melakukan kajian bersama (joint study) mengalami masalah keuangan internal. Perusahaan yang dimaksud merupakan perusahaan patungan antara perusahaan Indonesia dan Australia. 

“Kami pahami juga kalau kondisi keuangan, dari pada tidak ada pengembangan blok migas,” ujar dia.

Lelang Tahap Kedua

Pada paruh kedua 2018, pemerintah bakal menggelar lelang blok migas 2018 tahap kedua. Menurut Ediar, pihaknya menyiapkan lebih banyak blok migas dibandingkan dengan tahun lalu. Beberapa blok migas yang dilelang merupakan hasil joint study, sehingga akan dilelang melalui penawaran langsung.

“Ya lebih baik. Kalau begini, KKKS (kontraktor kontrak kerja sama) lebih optimistis. Mereka ada komunikasi, kalau joint study lebih bagus,” tutur dia. Sayangnya Ediar tidak merinci kapan lelang tahap kedua digelar.

Sementara itu, untuk lelang reguler tahap pertama 2018, masih berlangsung sampai pertengahan Juni 2018. Ediar menyatakan, perusahaan minyak dan gas yang menyerahkan dokumen lelang tercatat sangat banyak. “Blok yang diminati (blok) yang tetangganya sudah ada, dekat dengan fasilitas lain,” tambahnya.

Blok yang ditawarkan melalui lelang reguler ini adalah Blok South CPR Nibung, Batu Gajah Dua, Air Komering, Bukit Barat, East Sokang, Banyumas, East Muriah, North Kangean, Andika Bumi Kita, Belayan, West Sangasanga, Suremana I, Southeast Mahakam, Manakarra Mamuju, Karaeng, Ebuny, West Berau, dan Cendrawasih Bay II.

Pada lelang blok migas ini pemerintah mengatur minimal komitmen investasi dan bonus tanda tangan yang harus dipenuhi investor. Di setiap blok migas, minimal komitmen investasi yang diminta rata-rata berupa studi geologi dan geofisika (G&G) dan seismik, hanya 12 blok migas yang diminta ada pengeboran masing-masing satu sumur eksplorasi. Sementara untuk bonus tanda tangan rata-rata ditetapkan minimal US$ 500 ribu.

Contract of Termination Block Year 2019 Ready to Signed



Private oil and gas contractors will get the right of participation

Ministry of Energy and Mineral Resources (ESDM) will start applying Regulation of Minister of Energy and Mineral Resources No 23/2018 on Management of Oil and Gas Working Areas Ending Contract of Cooperation. Ministry of Energy and Mineral Resources this week will sign a contract extension of four blocks of oil and gas to contractors who are currently managed by existing contractors.



According to the new EMR Minister Regulation, all contracts that will be exhausted will be given to the existing contractor. So it is not given 100% to PT Pertamina. There are four oil and gas block contracts that expire next year. Fourth. the oil and gas blocks are Jambi-Merang Block managed by Joint Operating Body (JOB) Pertamina-Talisman Jambi Merang, and Pendopo & Raja block managed by JOB Pertamina-Golden Spike Energy Indonesia. Then Blok Bula is managed by Kalrez Petroleum (Seram) Ltd, and Seram Non Bula with operator Citic Seram Energy.



Deputy Minister of Energy and Mineral Resources (ESDM) Arcandra Tahar revealed that the government wants to immediately decide the management of oil and gas blocks that will expire contract and this week will also soon be signed a new contract termination region.

Kontrak Blok Terminasi Tahun 2019 Siap Ditanda tangani


Kontraktor minyak dan gas swasta akan mendapatkan hak partisipasi

Kementerian Energi dan Sumber Daya Mineral (ESDM) akan mulai menerapkan Peraturan Menteri ESDM No 23/2018 tentang Pengelolaan Wilayah Kerja Migas yang Berakhir Kontrak Kerjasamanya. Kementerian ESDM pekan ini akan menanda tangani perpanjangan kontrak empat blok migas kepada kontraktor yang selama ini dikelola kontraktor eksisting.

Menurut Peraturan Menteri ESDM baru tersebut, semua kontrak yang akan habis akan diberikan kepada kontraktor eksisting. Jadi tidak diberikan 100% ke PT Pertamina. Terdapat empat kontrak blok migas yang habis tahun depan. Keempat. Blok migas tersebut adalah Blok Jambi-Merang yang dikelola oleh Joint Operating Body (JOB) Pertamina-Talisman Jambi Merang, dan Blok Pendopo & Raja yang dikelola oleh JOB Pertamina-Golden Spike Energy Indonesia. Lalu Blok Bula yang dikelola oleh Kalrez Petroleum (Seram) Ltd, dan Seram Non Bula dengan operator Citic Seram Energy.

Wakil Menteri Energi dan Sumber Daya Mineral (ESDM) Arcandra Tahar mengungkapkan, pemerintah ingin segera memutuskan pengelolaan blok migas yang akan habis kontrak dan pekan ini juga akan segera ditandatangani kontrak baru wilayah kerja terminasi.

Menurut dia, kontraktor eksisting di blok yang habis kontrak pada tahun 2019 itu akan mendapatkan hak partisipasi atau participating interest. Hal ini sesuai dengan Peraturan Menteri ESDM No 23/2018. 

"Kami ikuti sesuai Peraturan Menteri ESDM," kata Arcandra.

Direktur Pembinaan Usaha Hulu Migas Ediar Usman menambahkan, Menteri ESDM Ignasius Jonan memang berencana akan menetapkan pengelolaan blok terminasi tahun 2019 pada pekan ini. Menurut dia, keempat blok terminasi tersebut bisa diproses lebih dahulu karena Kontraktor Kontrak Kerja Sama (KKKS) (KKKS) di masing-masing blok migas tersebut telah mengajukan penawaran ke pemerintah. 

     Meski akan diputuskan pekan ini, pemerintah masih melakukan negosiasi keempat blok migas terminasi tahun 2019. Dalam keputusan tersebut, Menteri ESDM akan mengatur besaran hak partisipasi untuk blok yang dikelola oleh dua KKKS, syarat dan ketentuan atau terms and conditions (T&C), bonus tanda tangan (signature bonus) hingga komitment pasti. 

"Jumat tanggal 11 Mei ditetapkan Pak Menteri," ujar Ediar.

Sebaliknya Marwan Batubara Direktur Eksekutif Indonesian Resources Studies (IRESS) meminta Presiden Joko Widodo segera membatalkan Peraturan Menteri ESDM No 23/2018. Argumennya, aturan itu bertentangan dengan konstitusi Pasal 33 UUD 1945, menghambat peningkatan ketahanan energi nasional dan melanggengkan penguasaan minyak dan gas oleh pihak asing. 

"Yang terpenting mengurangi potensi penerimaan negara sektor migas," katanya.

Pemberlakuan Peraturan Menteri juga menghambat dominasi di negeri sendiri dan menunjukkan sikap inferior bangsa Indonesia di hadapan bangsa-bangsa lain di dunia.

"Peraturan Menteri ESDM ini memberi jalan mulus kepada kontraktor asing (eksisting) melanjutkan pengelolaan wilayah kerja (WK) yang kontraknya berakhir," ungkap dia.

Three Challenges Confront Oil and Gas Business



The Indonesian Petroleum Association (IPA) assesses that the dynamics of the world oil and gas industry in the last four years requires stakeholders to adapt. Government as a regulator, must revise and even remove a number of rules. On the other hand, oil and gas companies must improve the efficiency of production activities.

Ronald Gunawan, President (IPA), delivered a series of discussions of various parties for three days IPA Convex is expected to contribute to various issues in the upstream oil and gas sector of Indonesia.

"We consider the upstream oil and gas sector in Indonesia is still very attractive, because we can feel the same focus to improve the competitiveness of upstream oil and gas investment in the eyes of global investors," said Ronald Gunawan, last weekend.

Meanwhile, Head of Special Unit for Upstream Oil and Gas Business Activities Amien Sunaryadi said one of the forms of support needed by oil and gas companies is from the Indonesian financial industry, by facilitating the mobilization of funds for oil and gas projects. In addition, all parties must support exploration by facilitating permits, smooth land acquisition, minimize levies and facilitate social settlement when it arises.

Indonesian Petroleum Association (IPA) menilai, dinamika di industri minyak dan gas dunia dalam empat tahun terakhir menuntut stakeholder menyesuaikan diri. Pemerintah sebagai regulator, harus merevisi bahkan menghapus sejumlah aturan. Di sisi lain, perusahaan migas harus meningkatkan efisiensi kegiatan produksi.

Ronald Gunawan, Presiden (IPA), menyampaikan serangkaian diskusi berbagai pihak selama tiga hari IPA Convex diharapkan memberikan kontribusi atas berbagai isu yang ada di sektor hulu migas Indonesia. 

"Kami menilai, sektor hulu migas Indonesia masih sangat menarik, karena kami bisa merasakan adanya kesamaan fokus demi memperbaiki daya saing investasi hulu migas tanah air di mata investor global," papar Ronald Gunawan, akhir pekan lalu.

Ada tiga isu yang menjadi tantangan perusahaan migas. Pertama, perkembangan teknologi informasi hingga perkembangan terkini dari teknologi operasional dan model bisnis yang tepat untuk sektor hulu migas. Kedua, efisiensi saat menghadapi krisis. Ketiga, peta kompetisi investasi industri migas global.

Menurut Ronald, salah satu hal yang menjadi concern adalah terkait perlunya pembagian tanggung jawab antara investor dan pemerintah dalam mendorong investasi dan pertumbuhan industri migas, Sebagai contoh, investor bisa menawarkan kemampuan dalam hal teknis dan finansial, pengalaman secara global, hingga pembangunan kapasitas. 

"Pemerintah bisa menyediakan iklim investasi yang mendukung dan stabil, serta regulasi yang efisien," ungkap dia.

Misalnya, IPA mengumpulkan para pemangku kepentingan dalam industri hulu migas. Termasuk pembuat kebijakan, pemerintah, investor dan sektor penunjang industri migas untuk mendorong lebih banyak investasi ke Indonesia.

Sementara itu, Kepala Satuan Kerja Khusus Pelaksana Kegiatan Usaha Hulu Minyak dan Gas Bumi Amien Sunaryadi mengatakan, salah satu bentuk dukungan yang diperlukan perusahaan migas adalah dari industri keuangan Indonesia, dengan memfasilitasi mobilisasi dana untuk proyek-proyek migas. Di samping itu, semua pihak harus mendukung eksplorasi dengan memudahkan perizinan, memuluskan pembebasan lahan, meminimalkan pungutan dan memfasilitasi penyelesaian aspek sosial apabila muncul.

Urges Cancellation of New Ministerial Regulation



The government is considered not giving priority to SOE companies to manage oil and gas assets in Indonesia. It is related to the Regulation of the Minister of Energy and Mineral Resources No. 23 of 2018. The insistence on the cancellation of the regulation was prominent. 

    Executive Director of Indonesia Resources Studies (Iress) Marwan Batubara said the regulation was contrary to the constitution, precisely article 33 of the 1945 Constitution. It also hampered the increase of national energy security.

"It maintains the mastery of natural resources and oil by foreign parties and hampers the domination of State Owned Enterprises to host the domestic oil and gas industry," he said.

As stated, the regulation was issued to replace Regulation of the Minister of Energy and Mineral Resources 15 / 2015. Article 2 of Regulation of Minister of Energy and Mineral Resources No. 15/2015 states that the management of Work Area (WK) is prioritized to be given to BUMN / Pertamina. Meanwhile, in Regulation of the Minister of Energy and Mineral Resources 23/2018, the termination block is prioritized in advance to Pertamina's new existing contractors.

"Deliberately aimed at providing a smooth way to the existing foreign contractors to manage the working area of ​​the KKS is over," he said.

He added that if referring to Constitutional Court Decision No 36 / PUU-X / 2012 as a result of judicial review on Oil and Gas Law 22/2001, the management of Oil and Gas Working Area should only be done by SOEs. Thus, the Ministerial Regulation shall automatically be null and void.

Desak Pembatalan Peraturan Menteri Baru


Pemerintah dinilai tidak memberikan prioritas kepada perusahaan BUMN untuk mengelola aset migas di Indonesia. Itu terkait dengan Peraturan Menteri ESDM No 23 Tahun 2018. Desakan pembatalan peraturan tersebut mengemuka. Direktur Eksekutif Indonesia Resources Studies (Iress) Marwan Batubara mengatakan, peraturan itu bertentangan dengan konstitusi, tepatnya pasal 33 Undang-Undang Dasar (UUD) 1945. Juga menghambat peningkatan ketahanan energi nasional. 

"Itu melanggengkan penguasaan SDA (Sumber daya alam) minyak dan gas oleh pihak asing serta menghambat dominasi Badan Usaha Milik Negara menjadi tuan rumah di industri minyak dan gas dalam negeri,” katanya.

Sebagaimana diwartakan, aturan tersebut diterbitkan untuk menggantikan Peraturan Menteri ESDM 15/ 2015. Pasal 2 Peraturan Menteri ESDM 15/2015 menyebutkan, pengelolaan Wilayah kerja (WK) diproritaskan untuk diberikan kepada BUMN/Pertamina. Sementara itu, pada Peraturan Menteri ESDM 23/ 2018, blok terminasi diprioritaskan terlebih dahulu kepada kontraktor existing baru Pertamina. 

”Dengan sengaja ditujukan untuk memberi jalan mulus kepada kontraktor asing (existing) melanjutkan pengelolaan Wilayah kerja yang KKS-nya berakhir" ujarnya.

Dia menambahkan, jika merujuk Putusan Mahkamah Konstitusi (MK) No 36/ PUU-X/ 2012 sebagai hasil judicial review atas UU Migas 22/ 2001, pengelolaan Wilah Kerja minyak dan gas hanya boleh dilakukan oleh BUMN. Dengan demikian, secara otomatis Peraturan Menteri tersebut harus batal demi hukum.

Expensive Costs, ExxonMobil Selective Hiring Foreign Workers (TKA)



ExxonMobil Indonesia considers that the issuance of Presidential Regulation No. 20 of 2018 on Foreign Workers Arrangement (TKA) facilitates the administration of foreign workers imported by ExxonMobil with certain expertise. Although still bringing in expatriates, EXXonMobil also remains committed to sending Indonesian workers to ExxonMobil Global.

Erwin explained, generally expatriates imported ExxonMobil Indonesia is at the level of experts, managers and engineering.

"Most experts, for engineering we see who has experienced in various countries," he said.

He explained that global oil and gas companies need workers who already have experience with global flight hours. For that reason, companies usually take directly from ExxonMobil Global in order to work in Indonesia.

Ongkos Mahal, ExxonMobil Selektif Pekerjakan Tenaga Kerja Asing (TKA)


ExxonMobil Indonesia menilai, terbitnya Peraturan Presiden Nomor 20 Tahun 2018 tentang Pengaturan Tenaga Kerja Asing (TKA) memudahkan administrasi bagi pekerja asing yang didatangkan ExxonMobil dengan keahlian tertentu. Meski masih mendatangkan ekspatriat, EXXonMobil juga tetap berkomitmen mengirim tenaga kerja Indonesia ke ExxonMobil Global. 

"Kami mengirim orang Indonesia sebanyak 20 orang ke ExxonMobil Global, atau lebih banyak dari mendatangkan orang asing ke sini," kata Vice President Public & Government Affairs ExxonMobil Indonesia, Erwin Maryoto akhir pekan lalu.

Dia bilang, saat ini operasi Banyu Urip di Blok Cepu tercatat paling efisien karena memang pekerja asing atau ekspatriat yang didatangkan dari ExxonMobil Global hanya 4% dari jumlah karyawan 350 karyawan di Blok Cepu.

"Mendatangkan ekspatriat mahal, jadi kami juga tidak akan mendatangkan yang tidak kami butuhkan," ujarnya.

Erwin menjelaskan, umumnya ekspatriat yang didatangkan ExxonMobil Indonesia ada pada level tenaga ahli, manajer dan juga engineering. 

“Paling banyak tenaga ahli, untuk engineering kami melihat yang sudah berpengalaman di berbagai negara," kata dia.

Dia menjelaskan perusahaan migas global membutuhkan tenaga kerja yang sudah memiliki pengalaman dengan jam terbang global. Untuk itu, perusahaan memang biasanya mengambil langsung dari ExxonMobil Global agar bisa bekerja di Indonesia.
